Items that make up a vehicle rental agreement

A typical contract is drawn up according to a simple scheme:

How to fill out the contract form?

The contract can be written completely by hand, or you can simply print out the finished form - the essence of this does not change.

Subject of the contract.

This paragraph indicates that the lessor transfers the vehicle for temporary use to the lessee.

We indicate all the registration data of the car:

Be sure to indicate in one of the subparagraphs on what basis this vehicle belongs to the lessor - by right of ownership.

Duties of the parties.

The order of calculations.

From what date until what date the contract is in force - for a year, two years, and so on (from January 1, 2013 to December 31, 2014).

Responsibility of the parties.

What will happen if the tenant did not pay the money on time - a penalty of 0,1 percent or more. It is also important to indicate the responsibility of the lessor if during the operation it turns out that the vehicle had any defects that could not be detected during the initial inspection - for example, the owner used additives in the engine to mask serious breakdowns in the cylinder-piston group.

We remind you that contracts between individuals or individual entrepreneurs are filled in this way. In the case of legal entities, everything is much more serious - every little thing is prescribed here, and only a real lawyer can draw up such an agreement.

That is, each item is signed in great detail. For example, in the event of the loss or serious damage to the vehicle, the lessor has the right to demand compensation only if it can prove that the Lessee is to blame - and we know that it can be very difficult to prove or disprove anything in court.

So, we see that in no case should one treat the drafting of such agreements lightly. Each item must be clearly spelled out, and especially force majeure. It is advisable to specify what exactly is meant by force majeure: natural disaster, moratorium of the authorities, military conflicts, strikes. We all know that sometimes there are insurmountable circumstances in which it is impossible to fulfill our obligations. It is necessary to set clear deadlines for when you need to contact the opposite side after the onset of force majeure - no later than 10 days or 7 days, and so on.
