Obligations and rights of drivers of motor vehicles

2.1

The driver of a power-driven vehicle must have:

a)certificate for the right to drive a vehicle of the corresponding category;
b)registration document for a vehicle (for vehicles of the Armed Forces, the National Guard, the State Border Guard Service, the State Special Transport Service, the State Special Service, the Civil Rescue Operational Rescue Service - a technical ticket);
at)in case of installation of flashing beacons and (or) special sound signaling devices on vehicles - a permit issued by the authorized body of the Ministry of Internal Affairs, and in case of installing an orange flashing beacon on large and heavy vehicles - a permit issued by an authorized unit of the National Police, except for cases of establishing flashing orange beacons on agricultural machinery, the width of which exceeds 2,6 m;
d)on route vehicles - a route diagram and a timetable; on heavy and bulky vehicles that carry dangerous goods, - documentation in accordance with the requirements of special rules;
e)a valid insurance policy (Green Card insurance certificate) on concluding a compulsory civil liability insurance contract for land vehicle owners or a valid internal electronic contract of this type of compulsory insurance in a visual form of an insurance policy (on electronic or paper media), information about which is confirmed information contained in a single centralized database operated by the Motor (Transport) Insurance Bureau of Ukraine. Drivers who, in accordance with the law, are exempted from compulsory civil liability insurance of owners of land vehicles on the territory of Ukraine, must have with them relevant supporting documents (certificate) (edition of 27.03.2019/XNUMX/XNUMX);
d)in the case of a “Driver with a disability” identification mark installed on a vehicle, a document confirming the disability of the driver or passenger (except for drivers with obvious signs of disability or drivers who transport passengers with obvious signs of disability) (subparagraph added on 11.07.2018).

2.2

The owner of the vehicle, as well as the person who uses the vehicle legally, may transfer the vehicle to another person who has with him a certificate of the right to drive a vehicle of the corresponding category.

The owner of the vehicle may transfer such a vehicle for use to another person holding a driver’s license to drive a vehicle of the corresponding category, passing him a registration document for that vehicle.

2.3

To ensure road safety, the driver must:

a)Before departure, check and ensure the technically sound condition and completeness of the vehicle, the correct placement and securing of the cargo;
b)to be attentive, monitor the traffic situation, respond accordingly to its change, monitor the correct placement and securing of cargo, the technical condition of the vehicle and not be distracted from driving this vehicle on the road;
at)on vehicles equipped with passive safety devices (headrests, seat belts), use them and do not transport passengers who are not wearing seat belts. It is allowed not to fasten the person who teaches driving, if the student is driving, and in settlements, in addition, drivers and passengers with disabilities whose physiological characteristics interfere with seat belts, drivers and passengers of operational and special vehicles and taxis (subparagraph amended 11.07.2018 .XNUMX);
d)while driving on a motorcycle and a moped, be in a buttoned helmet and do not carry passengers without a buttoned helmet;
e)do not clog the carriageway and allotment of roads;
д)Do not create a threat to road safety through your actions;
f)to inform road-operating organizations or authorized units of the National Police about the identification of facts of obstruction of traffic;
is)not to take actions as a result of which roads and their components may be damaged, as well as harm to users.

2.4

At the request of the police officer, the driver must stop in compliance with the requirements of these Rules, as well as:

a)present for verification the documents referred to in paragraph 2.1;
b)give the opportunity to check the numbers of units and the completeness of the vehicle;
at)to give the opportunity to inspect the vehicle in accordance with the law if there are legal grounds for this, including using special devices (devices) reading information from a self-adhesive label of radio frequency identification about passing the mandatory technical control by the vehicle, as well as (updated 23.01.2019) checking the technical condition of vehicles, which, according to the law, are subject to mandatory technical control.

2.4-1 At the place where the weight control is carried out, at the request of an employee of the weight control point or a police officer, the driver of a truck (including a power-driven vehicle) must stop in compliance with the requirements of these Rules, as well as:

a)transfer for verification the documents specified in subparagraphs “a”, “b” and “d” of paragraph 2.1 of these Rules;
b)provide the vehicle and trailer (if any) for weight and / or dimensional control in accordance with the established procedure.

2.4-2 In the event that during weight and weight control, inconsistencies of the actual weight and / or overall parameters with the established norms and rules are revealed, the movement of such a vehicle and / or trailer is prohibited until the vehicle receives permits for driving on motor roads in the established order that exceed the weight or overall parameters regulatory, about which the corresponding act is drawn up.

2.4-3 On road sections within the border strip and the controlled border area, at the request of an authorized person of the State Border Service, the driver must stop in compliance with the requirements of these Rules, as well as:

a)present for verification the documents specified in subparagraph “b” of paragraph 2.1;
b)provide an opportunity to inspect the vehicle and check the numbers of its units.

2.5

The driver must, at the request of the policeman, undergo a medical examination in the prescribed manner in order to establish the state of alcoholic, narcotic or other intoxication or being under the influence of drugs that reduce the attention and speed of the reaction.

2.6

According to the decision of the police officer, if there are appropriate grounds, the driver must undergo an extraordinary medical examination in order to determine the ability to safely drive the vehicle.

2.7

The driver, in addition to drivers of vehicles of diplomatic and other representative offices of foreign states, international organizations, operational and special vehicles, must provide the vehicle:

a)police officers and health workers for the delivery to the nearest health care institution of persons in need of emergency (emergency) medical care;
b)police officers to perform unforeseen and urgent official duties related to the prosecution of offenders, their delivery to the bodies of the National Police, and for transporting damaged vehicles.
Notes:
    1. To transport damaged vehicles, only trucks are involved.
    1. The person who used the vehicle must issue a certificate indicating the distance traveled, the duration of the trip, his name, position, ID number, full name of his unit or organization.

2.8

A driver with a disability who drives a motorized stroller or a car marked with the identification mark "Driver with a disability" or a driver who carries passengers with disabilities may deviate from the requirements of road signs 3.1, 3.2, 3.35, 3.36, 3.37, 3.38 and sign 3.34, if available under it are tables 7.18.

2.9

The driver is prohibited:

a)drive a vehicle in a state of alcoholic, narcotic or other intoxication or stay under the influence of drugs that reduce attention and reaction speed;
b)drive a vehicle in a painful state, in a state of fatigue, as well as being under the influence of medical (medical) drugs that reduce the speed of reaction and attention;
at)drive a vehicle that is not registered with the authorized body of the Ministry of Internal Affairs, or that has not passed departmental registration if the law establishes the obligation to carry it out, without a license plate or with a license plate, which:
    • does not belong to this facility;
    • does not meet the requirements of standards;
    • not secured in a place designated for this purpose;
    • covered with other objects or contaminated, which does not allow to clearly identify the license plate symbols from a distance of 20 m;
    • unlit (at night or in conditions of insufficient visibility) or inverted;
d)transfer vehicle control to persons in a state of alcoholic, narcotic or other intoxication or under the influence of drugs that reduce attention and reaction speed, in a painful condition;
e)transfer the vehicle control to persons who do not have a license to drive him, if this does not apply to driving training in accordance with the requirements of section 24 of these Rules;
d)while the vehicle is in motion, use communications equipment holding them in hand (with the exception of drivers of operational vehicles while they are performing an emergency job);
f)use the “Driver with disabilities” identification mark if the driver or passenger does not have documents confirming disability (except for drivers with obvious signs of disability or drivers who transport passengers with obvious signs of disability).

2.10

In case of involvement in a traffic accident, the driver must:

a)stop the vehicle immediately and remain at the scene;
b)turn on the emergency signaling and install an emergency stop sign in accordance with the requirements of paragraph 9.10 of these Rules;
at)Do not move the vehicle and objects that are related to the accident;
d)take possible measures to provide medical assistance to victims, call a team of emergency (ambulance) medical care, and if it is not possible to take these measures, seek help from those present and send the victims to health facilities;
e)if it is not possible to perform the actions listed in subparagraph “d” of paragraph 2.10 of these Rules, take the victim to the nearest medical facility with his vehicle, having previously fixed the location of the traces of the incident, as well as the position of the vehicle after it has stopped; in the medical institution, inform your name and license plate of the vehicle (with the presentation of a driver’s license or other identification document, registration document for the vehicle) and return to the scene of the accident;
d)report a traffic accident to a body or authorized unit of the National Police, write down the names and addresses of eyewitnesses, wait for the arrival of police officers;
f)take all possible measures to preserve the traces of the incident, fence them and organize a detour of the scene of the incident;
is)prior to conducting a medical examination, do not consume alcohol, drugs, or medicines made on their basis (except for those that are part of the officially approved first-aid kit) without prescribing a medical worker.

2.11

If as a result of a traffic accident there are no casualties and no material damage has been caused to third parties, and vehicles can move safely, drivers (if there is mutual agreement in assessing the circumstances of what happened) can come to the nearest post or to the National Police to draw up the relevant materials, previously making a scheme of the incident and putting signatures under it.

Third parties are considered to be other road users who, in connection with the circumstances, were involved in a traffic accident.

In the event of an accident involving vehicles specified in the current contract of compulsory civil liability insurance, subject to the operation of such vehicles by persons whose liability is insured, the absence of injured (dead) people, and also subject to the agreement of the drivers of such vehicles regarding the circumstances of the accident , in the absence of signs of alcoholic, drug or other intoxication or being under the influence of drugs that reduce attention and reaction speed, and if such drivers draw up a joint report of a traffic accident in accordance with the model established by the Motor (Transport) Insurance Bureau. In this case, the drivers of the said vehicles, after drawing up the message specified in this paragraph, are released from the obligations provided for in subparagraphs "d" - "є" of paragraph 2.10 of these Rules.

2.12

The owner of the vehicle has the right:

a)trust in the prescribed manner the disposal of the vehicle to another person;
b)for reimbursement of expenses in the event that a vehicle is provided to police and health officials in accordance with paragraph 2.7 of these Rules;
at)for compensation for losses incurred due to non-compliance of the condition of roads, streets, railway crossings with traffic safety requirements;
d)safe and comfortable driving conditions;
e)request up-to-date information on road conditions and driving directions.

2.13

The right to drive vehicles may be granted to persons:

    • motor vehicles and wheelchairs (categories A1, A) - from 16 years of age;
    • automobiles, wheeled tractors, self-propelled machines, agricultural machinery, other mechanisms that are operated in the road network, of all types (categories B1, B, C1, C), with the exception of buses, trams and trolleybuses, from the age of 18;
    • cars with trailers or semi-trailers (categories BE, C1E, CE), as well as intended for the transportation of heavy and dangerous goods, from the age of 19;
    • buses, trams and trolleybuses (categories D1, D, D1E, DE, T) - from the age of 21.Vehicles belong to the following categories:

A1 - mopeds, scooters and other two-wheeled vehicles having an engine with a displacement of up to 50 cubic meters. cm or electric motor with power up to 4 kW;

А - motorcycles and other two-wheeled vehicles having an engine with a displacement of 50 cubic meters. cm and more or an electric motor with a power of 4 kW or more;

V1 - quad and tricycles, motorcycles with a side trailer, motorized wheelchairs and other three-wheeled (four-wheeled) motor vehicles, the maximum permissible weight of which does not exceed 400 kilograms;

В - cars, the maximum permissible mass of which does not exceed 3500 kilograms (7700 pounds), and the number of seats, in addition to the driver’s seat, is eight, the composition of vehicles with a category B tractor and trailer, the total mass of which does not exceed 750 kilograms;

С1 - vehicles intended for the carriage of goods, the permissible maximum mass of which is from 3500 to 7500 kilograms (from 7700 to 16500 pounds), the composition of vehicles with a tractor unit of category C1 and a trailer, the total mass of which does not exceed 750 kilograms;

С - vehicles intended for the carriage of goods, the permissible maximum mass of which exceeds 7500 kilograms (16500 pounds), the composition of vehicles with a category C tractor and trailer, the total mass of which does not exceed 750 kilograms;

D1 - buses intended for the carriage of passengers, in which the number of seats, except for the driver’s seat, does not exceed 16, the composition of vehicles with a tractor unit of category D1 and a trailer, the total mass of which does not exceed 750 kilograms;

D - buses intended for the carriage of passengers, in which the number of seating places, except for the driver's seat, is more than 16, a set of vehicles with a category D tractor and a trailer, the total weight of which does not exceed 750 kilograms;

BE, C1E, CE, D1E, DE - compositions of vehicles with a tractor of category B, C1, C, D1 or D and a trailer, the total mass of which exceeds 750 kilograms;

T - trams and trolleybuses.

2.14

The driver has the right:

a)drive a vehicle and carry passengers or goods along roads, streets or other places where their movement is not prohibited, in the prescribed manner in accordance with these Rules;
b)excluded on the basis of the Resolution of the Cabinet of Ministers of Ukraine No. 1029 dated September 26.09.2011, XNUMX;
at)know the reason for stopping, checking and inspecting the vehicle by an official of the state body that oversees traffic, as well as his name and position;
d)require the person who oversees the traffic and stopped the vehicle to present his identification card;
e)receive the necessary assistance from officials and organizations that are involved in ensuring road safety;
д)appeal the actions of the police officer in case of violation of the law;
f)to deviate from the requirements of the law in the event of force majeure or if other means cannot prevent the personal death or injury of citizens.
