According to the rules of the road, the roadside is intended for the movement of pedestrians, cyclists, horse-drawn carts, etc. on it. If a car has driven to the side of the road, but not for the purpose of stopping or parking, in the case when there is no more suitable place for parking, a minimum fine of 500 rubles awaits it.
In the Code of Administrative Offenses, this aspect is considered in a separate article, which provides for penalties in the following cases:
- roadside exit;
- oncoming traffic;
- obstructing the movement of an organized convoy of vehicles or pedestrians.
For all these violations, a fine of 500 rubles is provided (CAO 12.15 part one).
There is a separate clause in the rules - 9,9, according to which only those cars that deliver goods to stores have the right to move along the roadside, in the absence of other delivery methods.
It is difficult to prove anything to the inspector if he stops you for driving along the side of the road. Some drivers, for example, try to prove that they pulled onto the side of the road in order to find a place to stop, however, they did not succeed and were forced to drive along it for some distance. But such explanations almost never work.
Another interesting moment is the movement on the opposite side of the road. For example, you are leaving a secondary road to the main one, which is currently in a traffic jam. You can drag along in a toffee for a long time, or you can try to turn left onto the oncoming roadside and go around the cause of the traffic jam.
The penalty in this case will be more serious than the minimum monetary penalty, since you made the actual overtaking with violations, and also drove into the lane that is intended for oncoming traffic. Therefore, you will have to answer under Article 12.15 Part 4. In the updated table of fines, which began to work in September 2013, this is 5 thousand Russian rubles or the deprivation of a VU for four to six months.
In order not to get into such situations, it remains only to advise you to follow the rules of the road, to behave decently on the road, since you not only create additional problems for yourself, but also take time from other road users.
