What happens if you do not pass the rights after deprivation? Punishment


Deprivation of a driver's license is one of the most serious punishments for any car owner. You can lose a VU for a number of violations - we have already considered this issue in detail on Vodi.su.

Until September 2013, XNUMX, traffic police inspectors were allowed to confiscate VU from violators. Today, a completely different scheme operates.

According to the new rules, which began to apply after September 1.09.2013, XNUMX, the car owner is obliged to independently take the certificate to the traffic police department in within 3 days after the start of the court decision on the deprivation of his right to drive a vehicle of a certain category.

To do this, you need to contact the traffic police department, where you will be given an application form.

It must indicate:

  • by the decision of which magistrate you were deprived of your rights;
  • decision number;
  • series and passport number.

The application is filled in two copies, one of which remains with you. On it, the duty officer puts a mark that you have really surrendered your rights.

The period of deprivation begins from this moment. Now you need to patiently wait for it to end and apply to the same department for your rights.

If you do not have rights, for example, you have lost them, you need to hand over a temporary permit, or any other document that allows you to drive a car.

What happens if the rights are not passed?

Many drivers go to various tricks to avoid surrendering their rights. For example, some write a statement about the loss of a driver's license, receive a temporary permit, which they hand over, and drive with the original. There are also such motorists who simply do not give up their rights. At the same time, they try to bypass any posts by a third road.

What awaits them in such cases, according to Russian law?

There are several options here:

  • the rights have not been surrendered for any reason, while the driver does not use the car and does not catch the eye of the traffic police;
  • the driver did not pass the VU, but the inspector stopped him and found out that he was deprived of his rights.

In the first case, something especially terrible will not happen. In accordance with Article 32.7 of the Code of Administrative Offenses of the Russian Federation, a person is considered deprived of his rights, that is, he is still forbidden to drive, but the period of deprivation of rights is interrupted and begins after the moment the driver's license is handed over to the traffic police department.

All this information is entered into a single database. Thus, if you handed over the rights not after three days, but after 15, then you can get them back 15 days later. No administrative or criminal liability for such an offense is provided. You may be required to write an explanatory note that, for some reason, it was not possible to pass the VU.

If the driver, deprived of the rights, did not pass them and continues to use his vehicle, he is considered a malicious violator. The traffic police inspector will definitely check the series and number of your driver's license in the database. If it turns out that you have been deprived of your rights for a violation, you will have to answer under Article 12.7 of the Code of Administrative Offenses, Part 2.

It provides for the following penalties:

  • or 30 thousand rubles fine;
  • or arrest for 15 days;
  • removal from management;
  • sending the car to the impound.

Such cases in the practice of traffic police officers are quite frequent. In addition, aggravating circumstances are possible, for example, the driver is deprived of his rights, while driving while intoxicated.

In this case, you will have to answer under article 12.8 of the Code of Administrative Offenses, part 3:

  • suspension from driving;
  • sending a car to a car impound;
  • arrest for 15 days or a fine of 30 thousand rubles.

For individuals under both articles, punishment in the form of compulsory public works for 100-200 hours may follow.

As you can see, it is undesirable to joke with the law, because the consequences will be very serious. Well, the period of deprivation will begin from the moment the driver's license is handed over to the traffic police department.

Therefore, it is better to immediately surrender the rights after the entry into force of the decision. Today, all traffic police officers have tablets with access to the database, and it is unlikely that it will be possible to hide from them the fact of deprivation of the VU.
