The Energy Ministry informed that the European Commission agreed to abolish the excise tax on electric cars in Poland. With current prices for electric vehicles starting at 130 PLN, this could mean a drop in prices by several thousand PLN.

On what basis was the excise tax on electric vehicles canceled?

Based on the Law on Electric Mobility of January 11, 2018 In accordance with Art. 58 of the Law:

Article 58. The following amendments shall be made to the Law of December 6, 2008 on excise tax (Journal of Laws of 2017, paragraphs 43, 60, 937 and 2216 and of 2018, paragraph 137):

1) after art. 109, art. 109a added:

"Art. 109a. 1. A passenger car, which is an electric vehicle within the meaning of Art. 2 para. 12 of the Act of January 11, 2018 on electromobility and alternative fuels (Journal of Laws, para. 317) and the hydrogen vehicle within the meaning of Art. 2 paragraph 15 of this Law.

and:

3) after art. 163, art. 163a added:

"Art. 163a. 1. Until 1 January 2021, a passenger car that is a hybrid vehicle within the meaning of Art. 2 paragraph 13 of the Law of January 11, 2018 on electromobility and alternative fuels.

That is, there has been no excise tax since January 11, 2018?

No, it was still valid.

The European Commission had to agree to the abolition of the excise duty provided for in Article 85 of the Law on Electromobility:

Art. 85. (...)

2. The provisions of Art. 109a and art. 163a of the Law as amended by Art. 58 as amended by this Law apply:

1) from the date of the announcement of a positive decision of the European Commission on the compatibility of the state aid provided for in these rules with the common market or the statement of the European Commission that these rules are not state aid;

What is the current excise tax on electric vehicles?

Electric vehicles were treated like cars with an engine capacity of up to 2.0 liters. Such cars were subject to an excise tax of 3,1 percent of the value of the car.

Does this mean that new electric cars will fall in price by 3,1%?

Not necessarily.

The excise tax is collected after the vehicle has been imported, and from that moment on, the seller's markup, VAT, and other surcharges or discounts are added to the price of the vehicle. Thus, the difference in price may be several percent, but the final amount depends on the importer / seller.

Of course, it would be good if prices fell by 3,1% (or more), and sellers informed buyers that this is due to the abolition of the excise tax. For some time this type of promotion has been used in Poland by Nissan.

No excise tax on electric vehicles – since when has it been in effect?

Since when is there no obligation to pay excise tax?

ATTENTION! Date not specified yet [as of 24.12.2018/XNUMX/XNUMX Dec XNUMX]

The message from the Ministry of Energy was only "positive information", while on the website of the European Commission there is NO information about the excise tax on electric vehicles. It is not visible in the list of recent cases (link), or when searching for the only known Polish notification number (SA.49981). This means that the excise tax on electric vehicles is valid until the date of the official announcement of the decision, which has not yet been announced [as of 21.12.2018/XNUMX/XNUMX December XNUMX].

Can I apply for a refund of the excise tax I have already paid when buying an electric vehicle?

No.

According to the already cited Art. 85 of the Law on Electromobility excise is abolished (...) from the date of the announcement of a positive decision by the European Commission on the compatibility of the state aid provided for in these rules with the common market or the declaration of the European Commission that these rules are not state aid;

Does the abolition of excise tax apply to hybrids such as Toyota?

For Toyota, Prius Plug-in only. According to the Law on Electric Mobility, the abolition of excise tax applies to:

  • electric vehicles - no restrictions,
  • hydrogen cars - no limits,
  • plug-in hybrid with combustion engines less than 2 cc3 – until January 1, 2021 [the power limit is not included in the Electric Mobility Act and only appeared as an amendment to the Biocomponents and Biofuels Act].
