Electric vehicles without excise duty - when will the decision of the European Commission come out? [DATES]

The Electric Mobility Act abolished the obligation to pay excise tax on electric vehicles and modern plug-in hybrids. However, tax incentives CANNOT be used yet - this part of the law will come into force when the European Commission gives a positive opinion. When will it happen?

According to a comment posted on the Elektroz.pl forum by user Artur Vasiak, Poland's request to check whether the removal of excise duty on electric vehicles complies with EU laws was sent to the European Commission on January 2, 2018 with the number SA.49981.

Unfortunately, there is no application with this number on the website of the European Commission, i.e. it cannot be sought. Such a report is also not visible in the list of applications for the last three months.

Cancellation of excise tax in March? Is it in June? Is it in 2019?

Therefore, we began to consider other notices about the reduction or cancellation of the excise tax. Also in this case, we were unable to find any reports regarding electric vehicles. But by the way, we found out that the average time for making decisions in such cases from the moment of notification to the issuance of a decision is 3-6 months.

However, it should be remembered that lately we have not been living very well with the bodies of the European Union, we do not fulfill requests and do not fulfill orders, and we have adopted the Law on electromobility itself, transferring it to magnetic tape under the threat of impending sanctions (for which we voted yourself).

Official dates

The standard waiting time for a document in the queue is 3 months. It can be extended for another 3 months if the case requires a deeper analysis, plus 1 month for maintenance. If processes are already underway on this topic, or if it is necessary to coordinate them with the work of other teams, the law may be suspended for 12-18 months.

In other words: the date of the abolition of the excise tax on electric vehicles and plug-in hybrids in Poland has not been specified.

Does the European Commission block the law on electromobility?

Does waiting for an EU decision mean that the entire E-Mobility Law is invalid? Good: categorized. They are already in force rules regarding exemptions from parking fees on public roads or the possibility of driving on the bus lane.

The decision of the European Commission in the case described concerns Article 58 of the Law on Electromobility, more specifically Article 85, which makes the operation of Article 58 dependent on the decision of the European Commission.
