How to overtake slow-moving vehicles so as not to lose your driver's license

A situation familiar to every driver: you are late, and a tractor is driving in front of you at a snail's speed and slowing down the entire column. You immediately face a dilemma: to overtake such a vehicle or continue moving. Let's follow the rules of the road, which have specific instructions on how to act if slow-moving vehicles are moving ahead.

What vehicles are slow moving

So that drivers have no doubts about which cars fit the category of “slow-moving”, in the same paragraph 8 of the “Basic Provisions”, it is stated that a special “Slow-moving vehicle” badge in the form of an equilateral red triangle in a yellow border should hang on the back of the body. You see such a pointer - you can safely overtake, but adhering to the rules, which are described below.

If such a sign is not observed, but the car can still be classified as slow moving according to its characteristics, then according to the Decree of the Plenum No. 18 of October 24, 2006: it is not the fault of other road users that the owner of the vehicle did not bother to put a sign. So, when overtaking such a slow-moving vehicle, no one has the right to fine you.

Overtaking a slow-moving vehicle in the coverage area with the sign "Overtaking is prohibited"

The “Overtaking is prohibited” sign (3.20) officially prohibits overtaking any vehicles in its coverage area, unless they are low-speed cars, bicycles, horse-drawn carts, mopeds and two-wheeled motorcycles (Article 3 “Prohibition Signs” of Appendix 1 of the SDA).

In other words, if you passed this sign, then you were officially allowed to overtake an interfering car with a red and yellow designation. But only if, together with the sign on the road, intermittent road markings are applied (line 1.5), or there is none at all. In other cases, punishment is provided.

Through a solid

If there is no “Overtaking prohibited” sign on the road, a solid line divides the track, and a slow-moving vehicle is dragging in front of you, then you do not have the right to overtake it. For such an attempt, answer under Article 12.15 of the Code of Administrative Offenses of the Russian Federation, paragraph 4. According to it, for driving into the oncoming lane in violation of the markings, a fine of 5 rubles or deprivation of rights for a period of four to six months is imposed.

If the violation is noticed by a video recording device, then only money will have to be paid. For repeated misconduct during the same year, under paragraph 5 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation, the rights will be taken away for a year. The second time, when fixing with a camera, you will have to pay money again.

If you pay off your fine in the first 20 days from the date of issue of the decision (do not confuse it with the entry into force), then pay half of the cost - 2 rubles.

"Overtaking prohibited" and continuous

In the event that you have passed the “Overtaking is prohibited” sign, and a solid marking stretches nearby, then again you cannot overtake the slow-moving vehicle. Until 2017, this sign and the continuous line contradicted each other, but according to Appendix No. 2 of Article 1 of the SDA, the priority still remained with the sign, and it was possible to overtake a slow-moving vehicle, regardless of the markings. But later, clause 9.1 (1) was introduced into the SDA, which in any case prohibited driving into the oncoming lane and overtaking slow-moving vehicles and other vehicles on a road with a solid (1.1), double solid (1.3), or continuous with intermittent (1.11), if your the machine is located on the side of the continuous line.

Therefore, it is impossible to overtake a slow-moving car through a solid line in any situation. If you violate this rule, then you face a fine of 5 rubles or deprivation of rights for up to six months under article 000 of the Code of Administrative Offenses of the Russian Federation, paragraph 12.15. For a repeated violation during the same year, your driver's license will be taken away from you for twelve months. If what is happening is recorded by the camera, then the fine in any case will be calculated in money.

If you are not sure what kind of transport is driving in front of you, then it is better to wait until your roads pass at the intersection. This is wiser than risking another punishment, which can also threaten you with a long-term loss of a driver's license.
