How to return the rights after deprivation?

There are a large number of articles in the Code of Administrative Offenses under which a driver can be deprived of a driver's license: a car is not registered according to the rules, driving into the oncoming lane, speeding, driving while intoxicated. Under some articles, rights are deprived of only a month, but for repeated drinking - up to three years, and this period is planned to be increased to five years.

Whatever it was, but the deprivation of a driver's license is a very serious punishment, and during this time the driver will understand that it is better to follow the rules of the road than to ride in a cramped tram or subway. And of course, every motorist temporarily suspended from driving is looking forward to the moment when he will finally be given his license and he will be able to drive his car.

So what should you do when it's time to get your driver's license back?

How to return the rights after deprivation?

Changes since November 2014

In November 2014, new rules and a new procedure for obtaining rights after deprivation came into force. The most important thing to pay attention to is that now everyone must take an exam at the traffic police, regardless of the violation committed (you can prepare for the theoretical part of the exam with us). This requirement appeared back in 2013, but earlier only those who drove in a state of intoxication or became a participant in an accident with people injured in it were forced to take the exam.

The second important change is that you no longer need to present a medical certificate in order to take away your driving license. Only those who have paid their rights for such violations should present it:

  • driving while intoxicated or under the influence of drugs;
  • refused to undergo an examination at the request of the traffic police inspector;
  • at the scene of an accident in which he was involved, consumed alcohol or drugs.

Also, a certificate must be brought by those people who could not undergo a regular medical examination due to health contraindications.

Well, the third feature of the new procedure for obtaining a VU after deprivation is that the driver is obliged to pay all fines due to him.

Exam

The exam is held in the examination department of the traffic police. You can hand it over when half the term of deprivation has passed, that is, if the rights have been withdrawn for 4 months, then two months after the entry into force of the court decision, you can contact the department with a passport and a copy of the decision.

The exam will be conducted in the usual manner - 20 questions, which need to be answered in 20 minutes. They will ask you only about the rules of the road, you don’t need to remember psychology and first aid - this will not be on the exam. Also, you will not need to take the practical part.

If you pass the test successfully - you gave no more than two incorrect answers - wait until the time you receive your driver's license. If the exam is failed, then the next one can be taken in seven days, and the number of repeated attempts to retake the test is unlimited.

Where to pick up a driver's license?

You need to get the rights in the traffic police department where the decision was made to deprive you of your driver's license. However, if this did not happen at the place of your registration, or you were forced to move to a new place of residence, then you can get a VU after deprivation at any traffic police department in Russia.

To do this, no earlier than thirty days before the end of the deprivation period, contact any department with the traffic police with a passport and a copy of the decision. You will be given an application form to fill out. Rights will be sent within 30 days.

What documents are needed?

According to the new procedure, which came into force in November 2014, it is enough to have only a passport from the documents. You don’t even need to present a copy of the decision, because thanks to the Internet, all information is stored in databases. However, knowing the quality of the connection, away from sin, you can take the decision with you.

In addition, you will also be checked for fines, so if you have receipts for them, then take them with you.

Those deprived of the right to drive a vehicle for drunkenness or for health reasons must present a new medical certificate confirming the absence of any contraindications.

It is not necessary to appear for the rights at the department immediately after the expiration of the deprivation period. Driver's license stored for three years in the archive. The main thing is not to arrive earlier than the due date, you will just waste your time. Although, according to the new rules, the entire return process will not take even an hour, but it depends on the workload of the traffic police.

Early return of rights

After the court decides that the driver needs to be deprived of a driver's license, he has 10 days to appeal.

After 10 days, the decision comes into force and the driver is obliged to hand over the VU. Returning rights in an illegal way - through a bribe, forgery, forgery - is prohibited.

For this, penalties are provided for under the Criminal Code:

  • 2 years in prison - for forgery;
  • 80 thousand fine, 2 years of corrective labor or 6 months of arrest - for forgery.

The only way to act is legally through the courts. An appeal must be filed before the entry into force of the court order. When the decision came into force, there is no legal way to return the rights.
