Electric Motorcycle EE Sticker - Own? [ANSWER] • CARS

One reader asked us if electric motorcycle owners could also get an EE sticker. We decided to check this information with the source, that is, in the Law on Electromobility.

In accordance with the Law on Electromobility (download: Law on Electromobility, FINAL - D2018000031701), article 55 of the Law - Law on Road Traffic, the following paragraph was added:

Article 148b. 1.From July 1, 2018 to December 31, 2019 electric vehicles and hydrogen cars marked with a sticker indicating the type of fuel used to drive them placed on the windshield of the vehicle according to the scheme specified in the regulations issued on the basis of Art. 76 sec. 1 point 1.

So, owners of electric vehicles are entitled to a sticker. What is this "electric car"? According to the definition of the Law on Electric Mobility, article 2, paragraph 12:

12) electric car - car within the meaning of Art. 2 paragraph 33 of the Law of June 20, 1997 - Law on Road Traffic, use to set in motion only the electricity accumulated when connected to an external power source;

Thus, owners of electric vehicles that can be charged externally are entitled to receive the sticker. What is a "car"? Let's check out the art. 2 points 33 Law - Law on Road Traffic (download: Law - Law on Road Traffic 2012, FINAL - D20121137Lj)

33) motor vehicle - cardesigned for movement at a speed of more than 25 km / h; this term does not include an agricultural tractor;

So we see that owners of cars and motorcycles have the right to receive the sticker.... But be careful! The EE sticker does not belong to the owners of mopeds, since the legislator deliberately excluded them from the category motor -> automobile -> electric vehicles:

32) car - car with engine except mopeds and rail vehicles;

In short: the owner of an electric motorcycle (marked “EE” in field P.3 of the registration certificate) is entitled to the EE sticker. However, owners of electric mopeds and tractors will not receive it, as they do not meet the definition.
