The cycling kilometer surcharge has just been published in the Journal. official. Good news for those who commute to work by e-bike.

25 cents per kilometer and up to 200 euros per year

The ordinance, published in the official magazine on February 11, 2016, sets the tolerance per kilometer at 0,25 cents per kilometer, without distinction between a classic bicycle and an electric bicycle.

This remuneration is beneficial for the employer as it is exempt from social security contributions in the amount of up to 200 euros per year per employee. If he wants to go further, then this, obviously, will be possible, but only at the expense of paying social contributions in excess.

As for the employee, the mileage amount will be exempt from income tax, as is already the case with the costs associated with the use of public transport. However, as far as the employer is concerned, this exemption is limited to 200 euros per year.

Help in conditions

Can all employees using an electric bike for work at work qualify for the mileage bonus? Oh no ! It can only be required by private sector employees with the consent of the employer. Thus, the conditions for applying compensation should depend on:

  • either by agreement between the employer and representatives of the representative trade unions in the company,
  • or a unilateral decision by the employer after consultation with the council of the enterprise or staff representatives, if any.

Thus, the success of this new measure, included in the energy conversion law, will depend on the employer's commitment to the system. And to promote the system and better monitor its implementation, ADEME and the Cycling Cities and Territories Club have opened an observatory dedicated to the cycling norm.
