Disabled parking: who has the right to use/park?


Until recently, there was one serious gap in the Russian legislation concerning the rules of the road, associated with the placement of the “Disabled driver” sign on the windshield of a car. We considered this topic on our portal Vodi.su.

The whole point was that the driver, at his own request, had the right to place this sign on his glass, and this gave him the right to use all the benefits for the disabled, in particular, to park in specially designated areas marked with sign 6.4 and sign 8.17.

There are many situations in life. For example, a certain motorist hangs this sign on his glass and takes the most convenient places in the parking lot. However, he has no exceptions. The traffic police inspector had no right to demand from him a certificate confirming disability.

On the other hand, a person with a clear disability or carrying one, but not having this sticker on the glass, could easily get a fine under Article 12.19 of the Code of Administrative Offenses. part 2 - 5 thousand rubles.

Changes in traffic rules in February 2016

In order to deal with this problem once and for all, back in January 2016, a resolution was adopted to amend the traffic rules. According to this document, now every person who hangs a sign “Disabled driving” on the windshield must have a certificate confirming their disability. Accordingly, the traffic police inspector has every right to demand this certificate from the car owner if there are no obvious signs of any bodily injury.

Pay attention to one point. Who has the right to park in disabled spaces:

  • people with disabilities belonging to the first or second group;
  • drivers transporting disabled people, supporting them as dependents, having a disabled child in the family.

Additions to the already existing articles of the Code of Administrative Offenses also appeared:

  • 12.4 p.2 - illegal application of the identification mark "Disabled" - 5 thousand rubles. fines for individuals;
  • 12.5 part 5.1 driving a vehicle with an illegally applied sign - 5 thousand.

That is, now, if a traffic police officer stops you and you cannot present him with a certificate of disability of the first or second group, you will be fined 5 thousand. Accordingly, disabled drivers or those carrying them are required to carry the following documents:

  • driver's license;
  • vehicle registration certificate;
  • OSAGO policy;
  • disability certificate.

It should also be noted that disabled people of the third (working) group do not have the right to park in the indicated places and use all other privileges provided to people with disabilities.

So, if everything is clear with the disabled - they must carry a certificate with them, then the following question arises: what to do if your family has a disabled child or an adult and you sometimes have to transport it.

For such cases, a quick-release plate on suction cups is provided. You can hang it on the windshield if a person with disabilities is in the car, and you have a certificate of disability.

You can, of course, find some holes in these changes. For example, you parked in a specially designated place, dropped off a disabled person and took him to the hospital in a chair. Help, respectively, will not be with you when you return to the car. How to prove to the inspector that the plate "Disabled driving" is pasted legally?

Lawyers note that it is impossible to make notarized copies of this certificate. Let's hope that over time this issue will also be resolved at the legislative level.

There are also problems with parking near large supermarkets or in paid parking lots. So, parking machines have not yet learned to recognize disability certificates, although according to the traffic rules, any parking lot, even paid parking, should have 10 percent of parking spaces for people with disabilities. Often, the parking lot guards themselves are not aware of the new changes and demand payment from disabled people.

In such cases, a parking permit procedure is provided, which gives the right to free parking in specially designated areas both in Moscow and other cities. Drivers who are raising children with disabilities or who have dependent adult family members related to them are also entitled to receive such permission.

Thus, summing up all of the above, we conclude that under sign 6.4 and sign 8.17 they have the right to park for free:

  • invalids of the first and second groups;
  • car owners transporting such.

There must be a sign on the glass “Disabled driver”, they must have a certificate with them to confirm the physical condition of the person. An important point is that only drivers of motor vehicles or motorized wheelchairs have the right to park. That is, if you arrived on a moped, scooter, quadricycle, etc., you are not allowed to stop here.
