Penalty for driving without light day and night 2016

Despite the fact that the requirement to drive during the day with the headlights on was put into effect back in 2010, the debate about the advisability of such a rule has not subsided so far.

Proponents of this innovation argue that the car becomes more visible to all other road users. Opponents also complain that fuel consumption increases, the battery runs out faster, light bulbs fail faster.

Traffic police inspectors give the following arguments in favor of this rule:

  • in the city in this way it is possible to better distinguish other vehicles with peripheral vision;
  • on the highway outside the city, the driver will be able to see oncoming traffic in advance and refuse risky maneuvers.

Be that as it may, traffic police officers vigilantly monitor the implementation of this order by drivers.

In order not to have to pay a fine, you need to remember to turn on either the dipped beam, or daytime running lights, or fog lights. Many drivers forget about this rule and as a result come across to the traffic police. When drawing up the protocol, the inspector is guided by article 12.20 of the Code of Administrative Offenses. It does not specifically talk about driving with the lights off, it simply states that for violation of the rules for the use of lighting devices, the driver is obliged to pay a fine of 500 rubles.

In addition, there is one more requirement - a driver who drives with the daytime running lights off automatically becomes guilty if he gets into an accident. That is, he may not even violate the rules of the road, but the inspector will take into account that the low beam was not on, which means that the true culprit of the accident did not notice this car and because of this the accident happened. As a result, he will not be able to receive full compensation for CASCO from the insurance company.

It is also a fairly common situation - with the onset of darkness, the driver forgot to switch from navigation lights to low beam. For such a violation, the same fine of 500 rubles is due under Article 20.20. Although, if you look at it, such forgetfulness creates a much more dangerous emergency on the road, since running lights are not designed for the dark time of the day and the driver with them will not be able to see anything in front of him.

Under the same article of the Code of Administrative Offenses 20.20, a fine is provided for the fact that the driver blinds other road users at night without switching from far to near when approaching vehicles.

Also to the driver faces a fine of 500 rubles even if its lighting fixtures do not meet the requirements of GOSTare dirty or do not work properly. It's no secret, after all, that many of us in the old fashioned way can drive with one burned-out light bulb or without one headlight at all. If you have such problems, then they need to be resolved as soon as possible, otherwise you will have to part with the amount of 500 rubles (CAO 12.5 part 1).

Requirements for lighting fixtures and daytime running lights

Many owners of vehicles that do not have running lights in their design install LED lights, since the rules of the road do not prohibit this. However, they must be installed in accordance with GOST and SDA:

  • not lower than 25 cm from the ground and not higher than 1 meter 50 cm;
  • the distance between the lights should not be less than 60 cm;
  • to the edge of the bumper should be no more than 40 cm.

White, orange and yellow light of running lights, dipped beam headlights or foglights is allowed. Red light prohibited. It is also forbidden to use the rear fog lamp in normal visibility conditions.

In addition, the rules state that the radiation area must be at least 25 cm square, and the radiation strength - 400-800 Cd. This is the optimal value for daylight hours, since such a radiation power cannot blind either oncoming drivers or pedestrians.

It is worth noting that the requirement to constantly drive with the lights on does not apply in all countries. In Ukraine, you need to turn on running lights only from October 1 to May 1, in Canada, all cars must be equipped with running lights, and not drive with low beams or fog lights. In the US, running lights are optional - studies have not shown that their inclusion leads to any noticeable reduction in accidents.
