The seat belt is a simple device that greatly reduces the risk of serious injury or death in a road traffic accident. The Rules of the Road clearly state:

  • the driver must wear a seat belt while driving;
  • The driver must ensure that all passengers are wearing seat belts.

Even if your car is stationary, it is advisable to buckle up as well, as you will be protected in the event of a collision. All cars must be equipped with seat belts, both in the front and in the back rows, if this rule is not met, then you will not be able to pass the technical inspection, and you will also not be able to get OSAGO, CASCO and DSAGO policies.

Particular attention is paid to the safety of children: a child under 12 years old must be transported in a special chair. If his height does not reach 120 cm, then fastening with a regular belt can injure him even in the event of sudden acceleration and braking.

  • article 12,6 of the Code of Administrative Offenses - a driver who is not wearing a seat belt pays a fine in the amount of 1000 rubles, the driver must pay the same amount if there is an unfastened passenger / passengers in his cabin (regardless of their number);
  • under the same article, a fine is imposed on the driver of a motorcycle if he or his passenger rides without a helmet or in an unfastened helmet;
  • article 12,29 of the Code of Administrative Offenses - a fine of 500 rubles is imposed separately on a passenger, and for each person separately, in some cases a written warning is allowed.

Separately, a fine is considered for violating the rules for transporting children, if a child travels without a child seat, then you will have to pay a fine of 3000 rubles.

Separately, it is worth noting that for an unfastened seat belt, you can get not only administrative responsibility, but also criminal. According to Article 264 of the Criminal Code, if serious bodily harm was caused as a result of the driver’s negligence, then this can lead to restriction of freedom for up to 5 years, arrest for 3-6 months, or imprisonment for up to 2 years. If there are human casualties due to the negligence of the driver, then a punishment in the form of imprisonment for 5 years and deprivation of rights for 3 years follows. If two or more people died, then a prison sentence of up to 7 years follows.
