Fine for dangerous driving - what threatens violators?


At the end of January 2017, the automotive community of Russia was surprised to learn that the State Duma adopted the draft law “On dangerous driving” in the first reading. A new article of the Code of Administrative Offenses under the number 12.38 will appear in the table of fines, according to which a fine of 5 rubles will be imposed on the driver for dangerous driving.

It is worth noting that further consideration of this law will take place in the State Duma on April 4, 2017.

Many deputies have already begun to make their amendments and proposals:

  • to replace the fine with deprivation of rights, provided that dangerous driving led to an accident, including a fatal one;
  • to toughen the punishment for repeated dangerous driving up to deprivation of rights for an indefinite period;
  • introduce higher fines for reckless drivers who constantly violate traffic rules and demonstrate dangerous behavior on the road.

In principle, on any news aggregator or search engine, you can find all the news with the tag "Dangerous driving". But, most likely, the deputies will be limited to a fine of 5 thousand rubles. It is possible that a subparagraph will be introduced to this article about repeated violations. Some of the deputies generally propose to deprive people of their rights for life - on the one hand, such proposals have the right to life, because the level of accidents on the roads is only increasing every year, despite the increase in fines and the tightening of traffic rules.

Definition of the concept in traffic rules

The ban on dangerous driving came into force on June 2016, 2.7. Clause XNUMX appeared in the Rules of the Road, in which this violation is described in detail. Up to this point, each of the violations was considered separately. For example, if the driver was engaged in street racing or neglected the traffic police requirement to stop and was chased, when drawing up the protocol, I will consider all the violations committed:

  • over speed;
  • driving through a red light;
  • rebuilding in heavy traffic and so on.

Now there is a clear definition. We will not give the full article, but we will consider the basic concepts.

So, dangerous driving is a violation in which the driver violated several points of the traffic rules at the same time, while endangering both himself and other road users.

What are these violations?

  • obstruction of overtaking;
  • sharp braking;
  • rebuilding with high traffic intensity;
  • non-observance of the mandatory distance while driving, as well as lateral intervals;
  • failed to give way to another vehicle when changing lanes.

For all these violations, fines of 1500 and 500 rubles are already provided. Now the inspector will not need to make a long list of violated traffic rules, but simply describe everything briefly and clearly: “Dangerous Driving”.

Conditions for imposing a fine

In order to minimize the arbitrariness on the part of regulatory authorities, the SDA and the Code of Administrative Offenses will detail all the conditions under which driving can be considered dangerous. So, if a driver commits successive violations within a short period of time, for example, fast lane changes, alternating with emergency braking, then he can be punished under this article.

If he repeatedly creates such situations on the roads, when the life and safety of property of other road users are endangered. If he violates the requirements for lateral intervals and distance, that is, he goes to a sharp approach to other vehicles, pedestrians or road structures. This list could go on and on.

Naturally, experienced drivers may have a number of questions:

  • violations must follow each other?
  • What is the time interval between violations?
  • how will it all be fixed?

Imagine a situation where a driver violates the rules in a dense traffic flow. We have already talked about the rules for changing lanes in heavy traffic on Vodi.su. If a collision occurs because of their non-observance, what rules are violated? First, the driver apparently did not give priority to the lane change. Secondly, he neglected the requirements for the minimum allowable distance. Thirdly, he created an emergency situation.

Each of these items has its own article in the Code of Administrative Offenses. But now, if the law "On dangerous driving" is adopted, all of them will be classified according to Art. Code of Administrative Offenses 12.38 and a fine of 5 rubles will be imposed on the violator. If the article is adopted with subparagraphs about repeated or systematic violations, then the driver may lose his license for life (although there are serious doubts that such a measure will be approved).

In any case, the law will still undergo comprehensive consideration and discussion. Motorists, on the other hand, can be advised to adhere to the rules of the road, especially in dense traffic flows. In this case, it will be possible to avoid both serious monetary fines and deprivation of rights.
