Lawn parking ticket 2016

The situation in modern cities is such that there is not enough space for a growing amount of transport. If we go to the central part of any city during working hours, we will see that cars are parked wherever possible: on sidewalks, lawns, playgrounds.

If everything is clear with the sidewalk and the roadway - this is a direct violation in accordance with the Code of Administrative Offenses and traffic rules, then with lawns everything is much worse - there is no definition of "lawn", respectively It doesn't say you can't park on it..

We read the rules of the road - where parking is allowed and prohibited.

It clearly states that you cannot leave your car at railroad crossings, at bus stops, at pedestrian crossings, and so on. There is a point that you can not park your car where it will interfere with pedestrians. But pedestrians, as you know, do not trample on lawns (if they are cultural).

In a word, nowhere is it said that parking on the lawn is a violation.

We conclude from this that you can park on the lawns, and the traffic police inspectors do not have the right to write you a fine for violating the rules of stopping and parking - they do not have the authority to do this, because you have not violated any of those laws that fall within the competence of the traffic police inspectors. But, such a conclusion turns out to be fundamentally wrong, and if a traffic cop writes you a fine for parking on the lawn, then this will most likely be Article 12.19 of the Code of Administrative Offenses, which deals with violations of the rules for stopping and parking vehicles.

The whole problem lies precisely in the fact that there is no definition of “lawn”, the traffic rules say that it is separated from the carriageway by a curb and serves to distinguish between the carriageway and the sidewalk. And if there is no definition, then you broke the rules and parked your car on the sidewalk.

Fine for such a violation: 1000 rubles for Russia and 3000 thousand for Moscow and St. Petersburg.

According to the Code of Administrative Offenses 12.19, part 3 and part 6, the detention of your car is also required, that is, add here the evacuation and all the costs associated with it.

Any lawyer will confirm to you the legitimacy of the actions of the traffic police. Although, if desired, such a decision can be challenged in court, and the same lawyer will tell you that on the basis of Article 30.2 of the Code of Administrative Offenses, you have the right to appeal against these actions of the traffic police inspector.

There is one more important point: in any region there are laws according to which parking on lawns is a violation and the amount of the fine can vary greatly depending on the city. There are regional laws on green spaces, which stipulate the amount of fines for stopping not only on lawns, but also in forest plantations, park areas and so on.

For Moscow, the amount of the fine will be from 4 to 5 thousand, in other cities - from a thousand to two and a half thousand.

You can also be fined, again according to local law, and for driving off the lawn, you will pollute the roadway.

It is very difficult to deal with all these requirements, it is not clear, for example, what you will be fined for and under what articles:

  • according to the Code of Administrative Offenses of the Russian Federation for violation of the rules for stopping and parking on the sidewalk;
  • according to the Code of Administrative Offenses of your city for stopping on the lawn and green spaces.

Or all together?

In a word, in order not to delve into all these difficult situations, understand the laws in your particular city, and, of course, do not park on the lawn, and in general on all those areas that even slightly resemble a lawn.
