It is impossible to find articles on the reloading of passenger cars in the Code of Administrative Offenses, since they simply do not exist there.

However, you should not think that the traffic police's observant inspectors will not find something to complain about if you overload your car with passengers or any cargo.

First let's understand Why can overloading a car be dangerous?

  • Firstly, the instructions for the car indicate the maximum allowable load weight, usually it does not exceed 350-500 kilograms, and it is simply dangerous to exceed this value - the frame and spars may not withstand, springs and shock absorbers may burst on bumps and pits.
  • Secondly, an overloaded car loses stability on the road. If the load is in the trunk, then the center of gravity will automatically shift and the front end will skid when turning. And with sudden braking, the car will completely lose control, and the braking distance will be longer.
  • Thirdly, when an overloaded car hits the roadway with its rear bumper, this is already a direct loss to the state, you spoil the roadway, and the inspectors will not forgive you for this.

What are the penalties for overloading a car?

As mentioned above, there is no article about overloading a car, but in some cases you can get fined.

So, paragraph 22.8 of the Rules of the Road says that the number of passengers must strictly comply with the technical characteristics of the car. It is impossible to transport four passengers in a four-seat sedan for a simple reason - there will not be enough seat belts for everyone. Therefore, you will have to prepare for the payment of fines:

  • for an unfastened passenger - 1000 rubles;
  • for violation of the rules of transportation - 500 rubles.

Well, plus to this, the passenger himself will have to pay 500 rubles, although he can get off with a simple warning.

Of course, if you take three well-fed passengers in a four-seat sedan, with a total weight of four centners, then you won’t break any rules, since they will all be fastened, but you will have to drive carefully.

If you load your car with violations, that is:

  • the cargo is located incorrectly and closes the entire view to the driver;
  • worsens the stability of the car and interferes with normal driving;
  • covers headlights, other lighting fixtures and license plates;
  • interferes with the movement of other vehicles, creates dust and noise, and the vehicle pollutes the environment due to overloading, –

then in this case, in the eyes of the inspector, you will be a violator of the rules for the transportation of goods, for which you will have to pay 500 rubles, although if you manage to agree, you can get off with a warning.
