Penalty points - add up and sometimes set aside!

Penalty points - add up and sometimes set aside! Now a driver who scores more than 24 penalty points in a year will lose his driver's license, and from the middle of next year he will have to take an additional training course. It is worth knowing that in some situations, points may be transferred to the account with a certain delay.

Penalty points are intended to be a whip for drivers who often break traffic rules. The rules are simple - if a driver scores more than 24 penalty points in a year, he will have to retake the driving test. Until he does this, he will not be able to drive a car. The mayor of the city or the district office, at the request of the police, sends him for testing. Drivers with less than a year of driving experience have a harder time. First, they lose them after exceeding 20 demerit points within a year. Secondly, in order to restore them, they will not only have to pass the exam, but also retake the driving course.

They are not afraid to take a driving test

Many motorists, especially those with long experience, are not afraid of re-examination for a driver's license and thereby exceeding the limit of 24 penalty points. Lech Szczygielski from the Provincial Traffic Center in Zielona Góra: – Many drivers decide to take another exam instead of a course, which deducts six points from their score. Contrary to what it seems, for an experienced driver, passing the category B driving license exam should not be a big problem. In addition, the course, due to which 6 penalty points are deducted from the driver's account, costs PLN 300, while the driving test costs only PLN 134. In addition, after checking the driving experience, the police will remove all demerit points. Penalty points, as you can see, do not apply to all drivers, so in a year and a half, the sanctions for exceeding them will change. Detailed information is provided below.

Be careful! Penalty points are summed up

At the moment, the old rules for scoring and punishing too many points apply. Since 2003, for each violation of the rules of the road, in addition to the car ticket, demerit points are awarded. From 1 to 10 points, depending on the severity of the offense - this is indicated in the order of the Minister of the Interior. It is important to note that demerit points are cumulative and there is no limit to the points a police officer can award for a single arrest. In extreme cases, the driver can lose his driver's license in a few minutes. If during a scheduled police check it turns out that the driver has more than 24 demerit points, then the driver's license is automatically retained by the traffic police officer. The police sends a document to the mayor or the president of the city with the rights of the county with a request to send the driver for a driving test.

Another thing is when the driver violated the rules of the road and was stopped for this reason. If it turns out that after the accrual of points for a newly committed offense, their level exceeds 24, a police driver's license is not allowed. – These points have not yet been credited to the driver's account. This will happen within a few days, after which the driver's license will be canceled, explains Andrzej Gramatyka, Deputy Head of the Zielona Góra Traffic Department. The police will send an application to the driver and the relevant communication department to send the driver for a driving test. The driver who received it must come to the office to be directed to the exam. He also cannot drive. If the police stop him, they will take away his driver's license and give him a fine. Everyone can check how many penalty points he has. This can be done at any police station. Oral information is free, fee for information is PLN 17.

Refusal to accept orders and court - points only after the verdict

If the driver refuses to accept the ticket, and hence the penalty points, the case goes to court. Only after his verdict - of course, if the court does not agree with the motorist - the points are transferred to the driver's account. Only then can the police revoke your driver's license. The sentence is sometimes even several months, during which the driver can use the driver's license.

There is a trap to be aware of. After a court verdict, demerit points go to the driver's account with the date of the offense, and not the court verdict. Therefore, it may happen that a motorist was deprived of a driver's license, despite the fact that some demerit points were erased from his account already after the last offense was committed, but before the court verdict.

Retraining courses - a way to write off penalty points

Penalty points are deducted from the driver's account one year after the offense was committed. You can reduce their number by taking a special course on road safety. The courses are organized by regional traffic centers, they last one day and cost PLN 300. Drivers who complete this course lose 6 demerit points from their account. During the year you can participate in two such courses, which means 12 demerit points. This method cannot be used by drivers with less than one year of driving license. In their case, exceeding the number of demerit points is an automatic loss of a driver's license.

Drivers will lose their driver's license after 48 demerit points

The changes will be made by the law on vehicle drivers, the provisions of which regarding demerit points will come into force from June 2018. According to its provisions, after exceeding the limit of 24 penalty points, the driver will be sent to a second course of study. He will lose his driver's license if he exceeds the 24-point limit again within the next five years.
