Cell Phones and Texting: Distracted Driving Laws in Hawaii

Hawaii has strict laws when it comes to distracted driving and the use of cell phones while driving. Since July 2013, texting and using portable mobile phones has been against the law for drivers of all ages. The Hawaii Department of Health reported that at least 10% of fatal car accidents in Hawaii were caused by distracted drivers.

In July 2014, the legislature introduced a change to the distracted driving law stating that drivers stopped at red lights or stop signs cannot use portable electronic devices, but those who come to a complete stop are exempt from the law. If you are under 18, you are not allowed to use a mobile phone at all, even if it is hands-free.

Законодательство

  • The use of portable mobile phones is prohibited, hands free is allowed for drivers over 18 years of age.
  • Drivers 18 and under are prohibited from using mobile electronics.
  • Texting and driving are illegal for drivers of all ages

A police officer can stop you if he sees a violation of one of the above laws and for no other reason. If you get stopped, you can get a ticket for the violation. Hawaii does not use a points system for licenses, so no points are awarded there. There are also several exceptions to these laws.

Fines

  • First violation - $200.
  • Second offense in the same year - $300.

Exceptions

  • Call 911, police or fire department

Hawaii has some of the strictest distracted driving laws in the United States, so it's important to be aware of this if you plan to drive in the state. Each offense is classified as a traffic violation, so you do not need to appear in court, just mail the ticket. If you need to make a call or send a text message, it is recommended to stop at the side of the road. This is necessary for your safety and the safety of others.
