For many motorists who are fond of tuning their cars, the news of the introduction of a fine (Article 12.5.1 of the Administrative Code of the Russian Federation) for modifying a vehicle came as a surprise. But besides the fact that they introduced restrictions, nowhere is it written in plain language for what exactly will be fined and what improvements need to be officially registered.

Literally, part 1, article 12.5 reads like this:

“Driving a vehicle in the presence of malfunctions or conditions under which, in accordance with the Basic Provisions for the Authorization of Vehicles for Operation and the Obligations of Road Traffic Safety Officials, the operation of the vehicle is prohibited, with the exception of malfunctions and conditions specified in parts 2 to 7 of this article, - entails a warning or the imposition of an administrative fine in the amount of five hundred roubles”

Lift suspension, snorkel, winch

Off-road enthusiasts are the most unfortunate, as their off-road tuning is very well determined by the inspector by eye. And the lifted suspension is no exception - they will write a fine for it and prescribe to eliminate the change to the factory state. Likewise, the snorkel and winch are not factory-fitted on the vehicle.

Tinting

Tinting of the front side windows is allowed only on condition that it has 70% light transmission. The windshield cannot be completely tinted, even minimally, only the tint of the strip from the upper border of the glass is allowed no more than 14 cm. Rear and rear side windows without restrictions.

In principle, the ban on tinting existed before the start of fines under Article 12.5.1, but then it was even stricter, up to the withdrawal of the vehicle for a parking fine.

Exhaust system

The so-called forward flow is much louder than the standard exhaust and it violates the loudness limit of 96 dBA + - 5 dBA. You can also get a fine of 500 rubles for this.

Additional optics

Fans of non-standard xenon or neon illumination fall into the scope of violators, since according to the vehicle regulations it is impossible to equip “diffusers and lamps that do not correspond to the type of lighting device”. This also includes the installation of lighting devices, for example, red, but the punishment is already tougher - a fine of up to 5000 and deprivation of rights up to 6 months.

What is considered additionally installed optics - firmly fixed parts of the optics to the body and powered by the car's on-board circuit.

Steering

Oddly enough, but the installation of a sports steering wheel is also prohibited, since it is a replacement for the control element of the vehicle. We quote verbatim: “there are movements of parts and assemblies not provided for by the design.”

Body kit

What cannot be installed: bumpers (both conventional and power), which differ in their design from the factory, change the length / width of the car. Relatively speaking, if the tuned bumper protrudes forward more than the standard one, then this is already considered an unacceptable modification and falls under Article 12.5.1.

Kangaroo

The official regulations prohibit the installation of non-standard devices protruding from the front bumper on all passenger cars with <8 passenger seats, as well as trucks with a carrying capacity of up to 3,5 tons, in other words, all vehicles that require category B to drive.

  1. Preliminary conclusion of the technical expertise on the possibility of making specific changes (made in specialized companies);
  2. Providing a car in stock condition for inspection at the traffic police;
  3. Next, all the planned tuning and improvements are made, while a declaration statement is filled in about what work has been done (as a rule, it is filled out by the service).
  4. Now you need to go through a technical inspection and get a diagnostic card with a permit to operate the vehicle with the changes made.
  5. And with the received documents, we go to the MREO, where they will once again check the installed details and enter them into the official documents of the TCP and STS.

Full text of Article 12.5.1

Article 12.5 of the Code of Administrative Offenses of the Russian Federation. Driving a vehicle in the presence of malfunctions or conditions under which the operation of vehicles is prohibited, or a vehicle on which the identification mark “Disabled” is illegally installed

1. Driving a vehicle in the presence of malfunctions or conditions under which, in accordance with the Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety, the operation of the vehicle is prohibited, with the exception of malfunctions and conditions specified in parts 1.1 - 7 of this article, shall entail a warning or the imposition of an administrative fine in the amount of five hundred rubles.

1.1. Driving a vehicle in respect of which a diagnostic card is not issued in accordance with the established procedure, confirming the admission of the vehicle to participate in road traffic, – shall entail the imposition of an administrative fine in the amount of two thousand roubles.

2. Driving a vehicle with obviously defective braking system (except for parking brake), steering or coupling device (as part of a train) – shall entail the imposition of an administrative fine in the amount of five hundred rubles.

3. Driving a vehicle, on the front of which there are light devices with red lights or red retroreflective devices, as well as light devices, the color of the lights and the mode of operation of which do not comply with the requirements of the Basic Provisions for the Admission of Vehicles for Operation and the duties of officials for ensuring road safety, – entails deprivation of the right to drive vehicles for a period of six months to one year with the confiscation of these devices and devices.

3.1. Driving a vehicle on which glass is installed (including those covered with transparent colored films), the light transmission of which does not meet the requirements of the technical regulation on the safety of wheeled vehicles, – shall entail the imposition of an administrative fine in the amount of five hundred rubles.

4. Driving a vehicle on which devices for giving special light or sound signals (except for security alarms) are installed without an appropriate permit, – shall entail the deprivation of the right to drive vehicles for a period of one to one and a half years with the confiscation of the said devices.

4.1. Driving a vehicle on which an identification lamp of a passenger taxi or an identification mark “Disabled Person” is illegally installed, – shall entail the imposition of an administrative fine on the driver in the amount of five thousand rubles with confiscation of the subject of an administrative offense.

5. Use of devices for giving special light or sound signals (with the exception of burglar alarms) installed without an appropriate permit while the vehicle is in motion, – entails deprivation of the right to drive vehicles for a period of one and a half to two years with confiscation of the said devices.

6. Driving a vehicle, on the outer surfaces of which special color schemes of vehicles of operational services are illegally applied, - shall entail deprivation of the right to drive vehicles for a period of one to one and a half years.

7. Driving a vehicle on which the color scheme of a passenger taxi is illegally applied, - shall entail the imposition of an administrative fine on the driver in the amount of five thousand roubles.

Note. A person who has committed an administrative offense under Part 1.1 of this article shall not be held administratively liable for the second and subsequent cases of detection of such an administrative offense within twenty-four hours from the moment of the first detection of such an administrative offense.
