What to do if I was hit by a car

Every day you can hear reports that someone was hit by a car, the offender fled the scene of an accident. When you look at all this, it becomes obvious that living in a modern big city is life-threatening. Pedestrians, as a rule, do not understand the rules of the road, and if, God forbid, they are knocked down, they often do not know what to do and whom to contact.

So, you were hit by a car - what to do? It all depends on the situation and the consequences, and the consequences can be very different, up to the most disappointing.

Let's assume that you hit at a crosswalk, you will stay alive, though you will have to spend money on treatment, but the driver fled the scene. What to do?

What to do if I was hit by a car

  1. First, you should remember the number or at least the brand of the car.
  2. Secondly, immediately call the police and an ambulance. If your health condition allows, then you need to wait for the police and tell them everything as it was. Eyewitness accounts will also be very important, write down the contact details of those people who can confirm your words.
  3. Thirdly, upon the arrival of the police, you need to write a statement with a request to bring the culprit to justice. And fourthly, it is imperative that the doctors check your condition. If serious harm is caused to health - disability, long-term loss of ability to work - then the culprit can "rattle under article" 264 for two years and lose their rights for three years. If the damage is average (not associated with a risk to life) or minimal (short disability), then the driver faces civil and administrative liability.

The victim is obliged to personally initiate bringing the driver to civil liability - you need to file a lawsuit in court. From the culprit it is necessary to demand reimbursement of all costs for treatment, for missed working days, for temporary disability. Accordingly, all these facts must be documented by checks, sick leave.

You can and should also demand compensation for moral damage - you choose the amount yourself, but in our country you need to be realistic.

If the driver turned out to be a decent person and provides you with all possible assistance, then you also need to act based on the situation.

If you have earned a small bruise, then perhaps you don’t need to call anyone, just figure it out on the spot and that’s it. If there is damage to health, then you must definitely wait for the police and an ambulance. After the inspection, you will be issued a certificate of the accident and the severity of the damage. Based on this certificate, the damage caused to you will be paid at the expense of OSAGO. If OSAGO does not cover all the costs of treatment, then you will have to demand compensation through a civil court.

Separately, it is worth noting that in cases where the driver can prove that it was the pedestrian who became the culprit of the accident, then he has the right to demand punishment of the pedestrian and payment of compensation from him for car repairs. Therefore, the rules of the road must be observed by everyone - both pedestrians and drivers, so that there are fewer such situations.
