How to transfer ownership of a car in Delaware

Without a title, there is no proof that you own the car - the title belongs to the owner. If you are buying a car, you will need to transfer the name from the seller's name to your own. If you are selling a vehicle, you will need to transfer ownership from your name to the buyer's name. This also applies to the case of donating a car and even when inheriting a car from a relative. Of course, you need to know a few things about how to transfer ownership of a car in Delaware.

For buyers

There are a few important steps you need to take if you are going to buy a car, and this actually starts before you visit the DMV. You will need to do the following:

  • Fill out the Buyer Application on the back of the title, be sure to include your driver's license number and your date of birth.
  • Be sure to sign the Title Certificate, which is also on the back of the vehicle's passport. The seller must also complete this section.

After you complete the sections on the back of the title, you will need to go to the DMV office. Be sure to bring the following items with you:

  • Header with all fields filled in
  • Insurance information confirming that the car is insured
  • Your state-issued driver's license (note that you can also use two legal documents proving residence in the state rather than your license if you prefer)
  • Cash to pay various fees, namely:
    • $40 car registration fee
    • $35 Transfer of Ownership Fee ($55 if car has a lien)
    • 4.25% of the sale price or value of the exchanged item to cover the document fee

Common Mistakes

  • Failure to notify the State within 30 days of purchase (which will incur an additional $25 fee).
  • Missing sections on the reverse side of the header

For sellers

If you're selling a car, there are a few things you need to do in order for the buyer to transfer ownership to their name.

  • Be sure to complete the "Assignment of Title Deed" on the back of the vehicle title. Please note that if more than one person is listed in the title, both must complete this section.
  • Remove the seller's sales report from the header.
  • Give ownership to the buyer.
  • Complete the seller's sales report and deliver it to the DMV. Be sure to complete the fields completely, including the date of sale, the amount paid for the car, the buyer's name, the buyer's address, and your signature.

Gift and inheritance

The process of donating a car in Delaware is the same as buying one. However, if you inherit a car, you must bring proof of ownership, the original County Probate Registry document, and applicable fees to the DMV office.
