What is the penalty for overdue rights? When replacing: surname, term

As you know, the driver must have three main documents with him: a vehicle registration certificate, a mandatory OSAGO insurance policy and a driver's license. OSAGO and VU have their own validity period. Insurance is issued for one year, a driver's license is valid for ten years.

The validity period of the VU may be reduced in some cases:

  • in case of changes in the state of health, for example, with a sharp deterioration in vision or heart function, it is necessary to undergo a regular medical examination, which is displayed in the VU;
  • change of personal data - change of surname;
  • form damage;
  • loss of a driver's license;
  • revealing the facts that the VU were obtained on forged documents.

In a word, there is a separate column on the rights card, which indicates the date until which the VU is valid. If the driver gets behind the wheel with an expired license, he will face serious punishment.

Penalty for driving with an expired license

Driving with an expired VU is equivalent to driving a vehicle without an appropriate permit, and this is already a serious violation. There is no separate article for driving with an expired license, but there is an article of the Code of Administrative Offenses 12.7, which considers the issues of driving a car without a VU:

  • part one: driving without a license - punishable by a fine of five to 15 thousand, suspension from driving and detention of the vehicle;
  • part two: driving a driver who was deprived of his rights - a fine of 30 thousand, or compulsory work, or detention for 15 days;
  • part three: transferring the right of control to a person knowingly who does not have a certificate - 30 thousand.

In this issue, we are interested in the first and third paragraphs of this article. That is, if your rights expired (yesterday, a month ago or two years ago), you will face a fine of 5-15 thousand, suspension from driving, detention of the car. A more accurate amount is determined by the inspector and depends on how long ago the rights expired.

The third paragraph stipulates the following problem - renting a car or allowing a driver whose rights are not valid. In this case, the owner, to whom the car is registered, will be obliged to pay 30 thousand rubles.

Notice the word "knowingly". For example, if you hire a person for the position of a driver whose rights are valid for several more years or months, then this is not your problem, but his problem if he is stopped with an expired VU, since at the time of signing the contract the rights were valid. If the owner transfers control of the vehicle to a person with already expired rights, then he will be liable to the fullest extent of the law.

Thus, two conclusions arise:

  • check the expiration date of your VU;
  • check the validity period of the identity of the persons you allow to drive your transport.

The vodi.su portal draws your attention to the fact that no fines for an expired driver's license are provided only if you do not drive.

Applying for a new driver's license

To avoid fines, apply for a new VU on time. The traffic police website has information that new rights can be issued ahead of schedule 6 months before their expiration date. You need to have the following documents with you:

  • old rights;
  • your personal passport;
  • valid medical certificate;
  • receipt of payment of mandatory duty in the amount of 2 thousand rubles.

A medical certificate is issued for two years, but since it does not need to be presented to traffic police inspectors and is constantly carried in the car (except in cases of serious illness), most drivers undergo a medical examination and draw up a certificate immediately before applying for a new VU.

Recently, news was circulated that deputies plan to submit a number of laws for consideration, for example: when obtaining a new driving license, you need to pass exams on traffic rules or pay all existing fines in full. As for the exam, the information is not confirmed, so you can not prepare for the exam.

If you have unpaid overdue fines, then when you contact the traffic police, information about them will definitely come up, since each motorist is punched through the traffic police bases. Accordingly, you will not only have to pay all fines, but also pay fines for late payment, and this is a doubling of the amount by 2 times. That is, if you are punished for unreadable numbers (CAO 12.2 part 1 - 500 rubles), then as a result you will have to pay as much as 1500 rubles.

According to the new regulations, any department of the traffic police in the territory of the Russian Federation is issuing new forms of VU, so there is no need to contact your address. If you have all the documents on hand, issuing a new driver's license will take no more than an hour. Photos, by the way, do not need to be taken, as you will be photographed directly at the traffic police department.
