Do I need to retake the rights after deprivation?


In 2013, amendments to Article 32.6 of the Code of Administrative Offenses of the Russian Federation were adopted, according to which it is possible to return the rights seized for a particular violation of traffic rules by a driver after testing knowledge, that is, passing an exam on traffic rules.

In paragraph 4.1 of Art. 32.6 of the Code of Administrative Offenses of the Russian Federation also lists violations, after which it is mandatory not only to pass the exam, but also to undergo a medical examination to confirm that the person is in a normal physical condition to drive a car. These are the violations:

  • Art. 12.8 part 1 - driving a vehicle while intoxicated;
  • Art. 12.26 p.1 - refusal to undergo a medical examination for alcohol content;
  • Art. 12.27 p.3 - the use of alcohol or drugs at the scene of an accident.

Thus, if a driver's license was withdrawn from the driver, he can return it only after successfully passing the exam for knowledge of traffic rules. If traffic rules were violated due to the use of alcohol-containing or narcotic substances, then it is necessary not only to pass exams, but also to undergo a complete medical examination.

So, it is very easy to calculate the time when you need to pick up your VU - look at the decision on deprivation of rights. It indicates the date from which you need to count another 10 days. It is 10 days that drivers are given by law to file an appeal due to disagreement with a court decision.

If, for example, your rights were taken away from you under article 12.15 part 4 - exit to the oncoming lane - for 4 months on September 20, 2017, then you need to go for them to the traffic police department on January 21, 2018. According to the amendments that have come into force, you can take the exam after half the term of punishment, that is, on November 20.

Due to the accuracy of the timing, you don’t need to worry too much. The main thing is not to come early. In the archive of the traffic police department, unclaimed documents can be stored for no more than three years, after which they are subject to destruction. At about half the term of deprivation, you can contact the traffic police and report your desire to pass the exam as soon as possible.

Early return of rights

In 2015/2016, some draft laws were adopted for consideration by the State Duma:

  • the possibility of early return of rights after the decision;
  • cancellation of the theory test after deprivation of rights for up to one year.

There is no information about the cancellation of the exam yet. Drivers who have committed minor violations can return the rights ahead of schedule, upon expiration of at least half of the term. The possibility of early return is not considered for those who drove with false numbers or documents, installed prohibited lighting or sound equipment, was detained for drunk driving, and refused to undergo a medical examination.

To return the rights ahead of schedule, you need:

  • pay all existing fines;
  • compensate for the damage caused to the victims, if any;
  • confirm in court their readiness not to violate traffic rules anymore;
  • demonstrate exemplary behavior - this fact is checked separately.

The theory exam is also required.

Exam

The exam itself is taken exclusively in the traffic police. You need to arrive in advance and present your documents, as well as a copy of the decision on deprivation of rights. Next, you write the corresponding application. You will be assigned a test day.

It is worth noting that the traffic police website officially states that passing any exams is free and there is no “examination fee” in the list of fees. However, for delivery, they may require to pay 1 thousand rubles. In case of failure, for each retake after 7 days, 4500 rubles are needed. The number of attempts is unlimited.

The exam is held in a standard form:

  • 20 minutes for everything;
  • 20 questions exclusively on traffic rules, there is no theory, no first aid, no legislation;
  • you can make no more than two mistakes.

Residents of some settlements of the Russian Federation complain that in their cities there is no way to pass an exam at the traffic police and they are either sent to another city or to Driving Schools, where this service is paid.

According to the available information, the vodi.su portal itself surrender and all subsequent retakes must be absolutely free. They have the right to demand money from you only if the term of the VU has expired and you need to make a new form. After passing the exam and paying all fines, it is quite possible to return the rights ahead of schedule, for this you need to go to court and file an application.
