Since last Friday, traffic inspectors have been working with speed cameras, that is, processing photos and sending them to drivers who have exceeded the speed limit.

For this purpose, the Center for Automatic Traffic Control was established as part of the Main Road Inspectorate. He receives photos taken by speed cameras across the country.

“Based on a photograph of a vehicle that has exceeded the speed limit, we determine who owns it. We send this person information about a registered offense,” explains Elvin Gajadhur from the Main Road Traffic Inspectorate in Warsaw.

Under the new law, if the car owner was not driving at the time of the recorded offense, he will have to say to whom he lent the vehicle at that time. If he fails to do so, he faces a fine of PLN 5000.

Recall that from the beginning of the year, traffic police inspectors can stop for inspection and punish drivers of cars and motorcycles (previously including trucks, buses, taxis) who grossly violated traffic rules. rules many movements.

Therefore, they have the right to track drivers, for example, using dashcams installed in unmarked police cars.

They may also stop for inspection drivers they suspect are under the influence of alcohol or drugs, running red lights, avoiding a vehicle that has stopped to let pedestrians pass, drivers making illegal overtaking, etc. They also have the right to identify the driver., checking the technical condition of the car and sobriety.

According to the new law, from July 1, only masts with speedometers and adapted for their installation can stand on the roads.

“So it is with the electrical installation, which allows you to connect a recording device and heating,” explains junior inspector Jacek Zamorowski, head of the traffic department of the Main Police Department in Opole.

However, the masts themselves must be better visible to perform a preventive function. Therefore, they will be covered with a yellow reflective film or painted yellow.

In front of speed cameras there should also be an information sign D-51 “Speed ​​control - speed camera” at a distance of:

– from 100 to 200 m – on roads with a maximum speed of 60 km/h,

- from 200 to 500 m - on roads with a maximum speed of more than 60 km / h, except for expressways and motorways,

- from 500 to 700 m - on high-speed and highway roads.

The traffic inspectorate took away from the police about 80 speed cameras and more than 800 masts across the country. The latter is also from the General Directorate of National Roads and Highways.

“We have installed all the speed cameras on the masts, the devices work around the clock,” says Alvin Gajadhur from the Main Road Traffic Inspectorate in Warsaw.

Recorders will be moved to new locations from time to time.

“By the end of this year, we plan to purchase over 300 new speed cameras,” says Alvin Gajadhur.

These speed cameras will be placed in the locations described in the list above, but they will also be moved to masts in other locations.

Speed ​​cameras will give drivers some headroom. We will not be fined if we exceed the speed limit by no more than 10 km/h. This also applies to speed cameras, which are also operated by city and municipal security guards.

However, this approval does not extend to other speed recording devices such as DVRs installed in unmarked police cars or so-called pistol speed sensors known as dryers.

The cameras will calculate the speed

Later this year, the Highway Patrol wants to start using a different whip against highway pirates. This is a system that can record cars and calculate their average speed over a given distance.

– At the beginning and end of the road section will be installed camera Alvin Gajadour explains. - When the car passes the first one, it will be recorded. Another camera a few or ten kilometers away will register the car again.

The system will then check the time the car has traveled over the distance and calculate the average speed. If it exceeds the allowed limit, the driver will be fined.

Ticket, photos from the speed camera - is it possible and how to appeal them

The system is currently being tested. Initially, employees of the Road Transport Inspectorate will designate about 20 locations throughout Poland where cameras will be installed.

“These will be the most dangerous sections of the road, for example, near schools, kindergartens, where there are more accidents,” emphasizes Elvin Gajadhur. We are still working on the details.

Calculates the tariff - fines and penalties for speeding

The amount of fines issued by the traffic inspectorate corresponds to the police tariff. The ITD also imposes demerit points for traffic violations registered by the ITD.

In case of speeding, the following penalty rates and demerit points apply:

– speeding from 6 to 10 km/h – a fine of up to PLN 50 and one demerit point 

– speeding from 11 to 20 km/h – fine from 50 to 100 PLN and 2 points

– speeding from 21 to 30 km/h – fine from 100 to 200 PLN and 4 points

– speeding from 31 to 40 km/h – fine from 200 to 300 PLN and 6 points

– speeding from 41 to 50 km/h – fine from 300 to 400 PLN and 8 points 

– collection at a speed of 51 km/h or more than the allowed speed – from PLN 400 to 500 with a fine and 10 demerit points

The new rules have increased the period of fine proceedings from 30 to 180 days (with a fine in absentia). This means that a speeding ticket can be imposed on the driver for up to six months from the date of registration of the offense. camera speed. This period also applies to city and municipal security, issuing fines based on photographs from speed cameras.

When is a photo from a speed camera considered invalid and can a ticket be issued based on it?

1. When the license plate of the car is not recognized in the photo (also on the sticker on the windshield)

2. When two cars are driving side by side in the photo.

3. When the speed camera does not have a legalization certificate.

City guards haven't traced yet

Also from July 1st city ​​guard they had to fight the road pirates with speed cameras.

“However, the new regulation on our formation is still awaiting the signature of the Minister of the Interior and Administration,” says Krzysztof Maslak, deputy commander of the city guard in Opole. According to him, before the entry into force of this resolution, the city and municipal security cannot issue fines based on photos from speed cameras.

If this becomes applicable, Rangers will be required to mark sign D-51 "Speed ​​Control - Speed ​​Camera" where they will take their measurements. If the speed camera is fixed (mounted on a mast), then the sign will be fixed. The mast, on which the guards can install the radar, should be yellow - like the ITD installations.

Expert: City guards can't control speed cameras!

However, if the guards have a portable speed camera, the sign can be put up during security checks as well.

When the new rules come into effect, Municipal Police he will be able to install his speed cameras on the roads of gminas, poviats, voivodships and state importance, but only in settlements. And only in those places that the police will agree to.
