The procedure for covering the mouth and nose is regulated by Journal of Laws No. Product of 2020 1829, which is available on the website of the System of Legal Acts on the Internet (source). Paragraph 1, paragraph 5 of it reads:

5) from § 27:

a) in sec. 1 of paragraph 1 of the words “and in vehicles used by non-residents, shall be deleted. or without joint management ",

b) in sec. 3:

- paragraph 1 is replaced by the following:

“1) a vehicle in which there are or are moving: at least one person or one person. a person who has at least one child referred to in paragraph 2; “,

The clause changes the decree of the Council of Ministers of October 9, 2020 on the state of the epidemic (Journal of Laws, positions 1758 and 1797), therefore we must refer to these documents taking into account the above corrections. We are only interested in the first decree of 1758 (source). Here it is, with recent adjustments, fatty came from the editorial board of www.elektrowoz.pl:

§ 27. Until further notice, there is a duty to cover the mask, mask, visor or protective helmet with clothing or its parts.referred to in Art. 40 sec. 1 of the Law of June 20, 1997 - Law on Road Traffic (Journal of Laws 2020, items 110, 284, 568, 695, 1087 and 1517), mouth and nose:

1) in means of public collective transport within the meaning of Art. 4 sec. 1 paragraph 14 of the Law of December 16, 2010 on public collective transport, on passenger ships in inland navigation in the understanding of the provisions on safety at sea or on inland navigation vessels referred to in Art. 5 sec. 1 point 1 lit. and the Law of December 21, 2000 on Inland Navigation Intended or Used for the Carriage of Passengers. and in vehicles used by people who do not live or drive together;

3. The obligation referred to in paragraphs 1 and 2 does not apply in case:

1) a vehicle in which there are or are moving: one person or one person with at least one child specified in paragraph 2, or persons living or driving together;1) a vehicle in which there are or are moving: at least one person or one person with at least one child specified in paragraph 2;

2) a child under 5 years old;

3) a person who cannot cover his mouth or nose due to:

a) common developmental disorders, mental disorders, moderate mental retardation, significant or deep

b) difficulty closing or opening the mouth or nose on their own;

Summation

Masks, visors, etc. DO NOT NEED to be used if:

  • at least one person is in a car,
  • One person is traveling in a car with at least one child under the age of five.

In the last ruling deleted mentioning people who “do not live together or do not drive together” who travel by car, we can easily conclude that no need to wear masks in the careven if we hire three friends.

From an epidemiological point of view, this is a step backward, but it solves the problem of paradoxical situations when someone had and did not have to wear a mask at the same time.

We add that the use of masks is still mandatory in public transport and in public places. And that this is eminently intelligent behavior, even if it is optional.
