Can the Opel Ampera / Mitsubishi Outlander PHEV / BMW i3 REx drive in the bus lane?

The Electric Mobility Act allowed electric vehicles to park for free in paid parking lots. This is determined by the indication "EE" on the registration certificate. What about driving on the bus lanes?

Answer: No, they cannot. Why? What determines this? Let's look at the sources. Let's start with the Electric Mobility Law, which added the following entry to the Road Traffic Law:

5) after art. 148, art. 148a and art. 148b added:

"Art. 148a. 1. Until January 1, 2026, electric vehicles specified in Art. 2, paragraph 12 of the Law of January 11, 2018 on electromobility and alternative fuels in bus lanes allocated by the road administrator.

And what is the aforementioned "electric car"? We find this in v. 2 point 12 of the Law on Electromobility:

12) electric car – motor vehicle within the meaning of Art. 2 paragraph 33 of the Law of June 20, 1997 - Law on Road Traffic, using only electricity accumulated when connected to an external power source for driving;

In other words: if the power source is external, that is, outside the vehicle, then, according to the law, we are dealing with an electric vehicle. According to the legislator, all other cars are not electric. Thus, Mitsubishi Outlander PHEV, BMW i3 REx or Opel Ampera - and other plug-in hybrids - CANNOT drive in bus lanes.because they have an additional source / drive of combustion energy. According to the law, these are not electric vehicles.
