Will the driver be fined if there is a naked passenger sitting next to him
During the January holidays, people are mostly busy with solemnly celebrating the passing of the old year and the arrival of the new. And often they do not deny themselves a drink, allowing too much. It is on such fun days that those celebrating can get into an awkward situation, or put others in such a situation. And perhaps even - to bring under the article. We will talk about those citizens who, for some reason, decided to ride as a passenger ... naked. What threatens them and the driver of the car in which such individuals travel, the AvtoVzglyad portal found out.
Surely taxi drivers, having spent at least a couple of years behind the steering wheel, managed to see everyone. But naked passengers, most likely, they did not meet often. But if this happened, the accompanying circumstances could be different: from a drunken desire to shock everyone who gets in the way, especially during mass festivities, to an anecdotal escape from the window of a beloved when her husband returned home ahead of time. The latter can, in principle, evoke sympathy from the driver.
But regardless of the reasons, the taxi driver himself, in addition to surprise, will have a logical question: will he be fined if he brings such an extraordinary passenger in Adam's suit.
The AvtoVzglyad portal decided to ask this question to a lawyer, and in addition to find out what is required by law for the rider himself, who threw off his clothes and ended up in the car next to the driver:
- Legally, the transportation of a naked passenger is not a violation, - said Konstantin Bobrov, director of the legal service of the Unified Protection Center. - The passenger himself can be held liable only for petty hooliganism, and even then if he appears in a public place in a naked state, while swearing obscenely, showing disrespect to others, pestering citizens, damaging other people's things ...
It is worth clarifying here that Art. 20.1 of the Code of Administrative Offenses of the Russian Federation "Petty hooliganism" provides for a fine of 500 or 1000 rubles or arrest for 15 days for "violating public order, expressing clear disrespect for society." But we must not forget that the salon of a personal car is not a public place.
Meanwhile, in order to attract a person under the aforementioned article, at least a couple of statements from citizens offended by an inappropriate appearance are needed, in addition, a demonstration of only primary sexual characteristics, that is, genitals, can be considered an “insult”. And it’s even better not to get caught in a negligee in the eyes of children. The Criminal Code can already start working here: article 135 - “Indecent acts without the use of violence against a person under the age of sixteen.” Then you won't get off with a small fine.
By the way, there is at least one more nuance: you still need to get into the car. It can be assumed that not every helmsman agrees to put a naked person into his cabin or continue transportation if the latter decides to undress right in the cabin.
“Of course, if by your behavior you pose a threat to the safety of the taxi driver or other passengers, or create an emergency situation, violate any rules of the Code of Administrative Offenses, the Criminal Code or the Rules for the Transportation of Passengers, the driver has every right to refuse transportation,” the lawyer specified to the AvtoVzglyad portal.
So, if suddenly someone had to try on the image of the medieval lady Godiva, who rode a horse through the whole city naked, and in the same form, for example, ride a taxi, he should remember that he must be quiet and not create emergency situations, preventing the driver from driving a car.
