§1. General Provisions.

5. The organizer declares that Competitionto which these rules apply is not a promotional lottery, gambling or mutual betting within the meaning of the Gambling Act of November 19, 2009 (Journal of Laws 09.201.1540, as amended).

6. Participant Competition can be any natural person who has reached the age of majority, has full legal capacity, and has a category B driver's license.

7. Employees cannot participate in the Competition. Organizer and other companies cooperating with the Organizer in organizing and holding Competition, as well as the closest relatives of the Organizer's employees and these persons. The closest family members are ancestors, descendants, siblings, spouses, siblings, stepson, son-in-law, daughter-in-law, siblings, stepfather, stepmother and brother-in-law, parents of spouses, cousins ​​and adopted persons.

§2 Competition Rules

1. Participation in the Competition is voluntary.

2. The contest task consists in the fact that the Participant sends answers to the contest questions and writes a text justifying the award of the prize to the Participant. Competition.

4. Questions will be posted between February 24, 2014 and March 28, 2014.

7. 9. Sending by the Participant answers to the competition questions, as well as the text sent by him, which will be incomprehensible, will contain imperfections, words and / or phrases that are usually considered uncivilized, vulgar or offensive, will lead to exclusion from the Competition.

10. The statement (work) of the Participant may not infringe on the good name of the Organizer, employees or persons cooperating with him, may not incite hatred, violence or perform other prohibited actions, may not have a political or religious connotation. The statement (work) must respect the generally accepted norms of morality, the personal rights of other people, it cannot contain any element capable of violating the principles of public order.

11. The statement (work) must be the work of the Contest Participant, in particular, it cannot be plagiarism or duplication of thoughts, slogans, statements of third parties. Each Contestant represents and warrants that his/her statement will be entirely original, will not be a derivative work of other works, and will not use any other works to which third parties would be entitled. The Participant of the Contest is solely and fully liable to the Organizer and third parties, including liability for harm, if the statement (Work) violates the rights of third parties, in particular their personal rights, property or personal copyrights, or generally applicable law.  

12. Any applications for participation in the Contest that do not comply with the Regulations will be rejected by the Contest Committee.

§3 Reward

1. The prize in the competition is the tuition of the 1.000,00 and 3rd degree at the Subaru Driving School for a total amount of PLN 3 and a cash prize in an amount equivalent to the flat rate of income tax payable referred to in § XNUMX point XNUMX. Organizer undertakes to pay Winner income tax from the award, in the amount established by the current legislation.

2. Training will take place using a car Winners.

3. Date and place of receipt of the prize are determined Winner directly with a Subaru Driving School employee specified by the Organizer.

4. The organizer, as a taxpayer, will charge income tax at a flat rate of 10%, specified in art. 30 sec. 1 point 2) of the Act of 26 July 1991 on personal income tax (Journal of Laws of 2012, item 361, as amended) and pays it to the account of the competent tax office. The winner of the Contest is obliged to provide information about the properties of the tax office before receiving the prize,

§4 Complaints

1. Complaints of the participants of the Contest are accepted in correspondence to the e-mail address [email is protected]. Complaints can be filed within 1 month from the end of the Competition. Complaints are considered by the Competition Commission within 14 days from the date of their receipt. The response to the complaint will be sent back in accordance with the method of filing the complaint: by e-mail or by registered mail to the return address, which must be indicated in the letter of complaint.  

2. The decision of the competition committee is final and depends on the subjective opinion of the members of the committee. The Commission is sovereign in the choices it makes.

§ 5 Copyright in expression (Work)

1. Sending by the Participant of the answers to the questions of the competition, as well as the text sent by him to the Organizer, is equivalent to the submission by the Participant of the competition of a statement that he is the sole author of the Work.

2. When a prize is awarded to the Winner, all copyrights to the awarded work (Work) of the Winner pass to the Contest Organizer, in addition, the right to dispose and use the awarded work both independently and for use by third parties. , without limitation of territory, in all forms and ranges of action and in all known fields of application, in particular:

a) in the field of recording and reproduction of the Work - making copies of the Work using certain techniques, including printing, reprographic, magnetic recording and digital technology,

b) in terms of trading in the original or copies on which the Work was recorded, marketing, loaning or leasing the original or copies,

c) as part of the distribution of the Work in a manner different from that specified in paragraph b) over public performance, display, display, reproduction, broadcasting and retransmission, as well as bringing the Work to the public in such a way that everyone can have access to it in the selected their place and time (including via the Internet).

d) The Organizer reserves the right to use the Work in any advertising and promotional activities, including as promotional or promotional materials or as an element of promotional or promotional materials.

3. The Organizer reserves the right to use the production (Work) without the need to indicate the name and surname of the author, to which the Contest Participant agrees by accepting these Regulations.

4. In case of doubts about the exclusive authorship of the work (Work) or in case of any objections or claims of third parties regarding the violation of their rights, the Winner is obliged, at the request of the Organizer, to provide explanations and immediately provide evidence confirming his exclusive authorship. If they are not presented or recognized by the Organizer as insufficient, the Organizer has the right to exclude such a review from the Contest, and in case of doubts, reservations or claims after the award of the Prize, the Organizer has the right to decide that such Winner will lose the right to the Prize, and then transfer the Prize to another Participant of the Contest or accept decision on other use of the Prize.

§ 6 Liability

1. The organizer is not responsible for:

a) the inability to issue an award for reasons beyond its control,

b) provision by the Participant of the Contest of incorrect, incomplete or inaccurate personal data, contact details and other information preventing the award of a prize,

c) the impossibility of submitting a competitive bid due to a failure in the operation of the Internet networks,

d) violations related to the work of third parties, such as: courier, post office, bank, Internet provider, etc.

e) problems during the Contest, if they arose as a result of force majeure, which should be understood as a sudden, unforeseen event, the consequences of which could not be prevented, in particular: natural disasters such as frosts, floods, winds, fires, acts of legislative power and executive power and disturbances in collective life, such as street riots or strikes,

f) damage caused by participation in the Contest contrary to the provisions of the Regulations,

g) any violations in the conduct of the Competition due to technical reasons (for example, maintenance, inspection, replacement of equipment) or for other reasons beyond the control of the Organizer.

2. The responsibility of the Organizer to the Participant of the Contest for any damage associated with his participation in the Contest is limited to the value of the prize due to him.

§ 7 Processing of personal data  

1. The provision of personal data by the Contest Participant is voluntary, but their absence makes it impossible to participate in the Contest.

2. Joining the Contest is tantamount to the Contest Participant's consent to the use and processing of their personal data for purposes related to the Contest, in particular, to select the Winner, award a prize and document the Contest, including to fulfill the public legal obligations of the Organizer. In addition, the Participant of the Competition agrees to the processing by the Organizer of his personal data for the purpose of direct marketing of the services provided by the Organizer, in particular, the names and surnames of the awarded Participants of the Competition may be published on the website and in the promotional materials of the Organizer.

3. The Participant of the Contest can at any time access his personal data and image, demand their correction, modification or deletion. Any comments on your data (comments, corrections) should be sent to the following address: [email protected]

4. The Organizer is the administrator of the personal data of the Contest Participants.

5. The Organizer will be able to contact the Contest Participants by phone, e-mail or letter.

§5 Additional provisions

1. Winner is not eligible to reserve special prize features.

2. The award referred to in § 3, paragraph 1 cannot be exchanged for another or for a cash equivalent.

3. Joining Competition is equivalent to the Participant's acceptance of the Regulations in full, the obligation of the Participant of the Contest to comply with the Regulations and the statement that the Participant of the Contest complies with all the conditions that give him the right to participate in the Contest.

4. Participation in the Contest, as well as any rights and / or obligations related to the Contest, in particular the right to issue a prize, cannot be transferred to another person.

5. Disputes relating to and arising out of Competition will be settled amicably and in case of disagreement of the competent person at the location Organizer general court in Krakow.

6.    To the organizer has the exclusive right arbitrarily:

a) determination of the content of the competitive task;

b) assessment of answers to the competitive task;

c) determination of laureates on the basis of the principles established by these Regulations;

d) removal of the Participant from participation in the Contest in case of violation of the Regulations.

8. The Organizer reserves the right to change the provisions of these Regulations at any time without giving reasons, including the right not to award a prize. Changes may not infringe rights acquired by Members.
