According to the new edition of the table of fines, which came into force in September 2013, the penalty for not allowing a pedestrian to pass has become tougher. Article 12.18 of the Code of Administrative Offenses clearly states:

  • If the driver does not give way to pedestrians or cyclists, he will be fined 1500 rubles.

The traffic rules say that at the entrances to a road crossing that is not regulated by a traffic light, the driver is obliged to slow down and let the pedestrian pass, even if he started moving from the opposite side of the road.

If a driver violates this rule at a regulated crossing, then a much more serious punishment awaits him:

  • 12.12 part 1 - running a red light - 1000 rubles, if the violation is repeated - a fine of 5000 rubles, deprivation of rights for 4-6 months;
  • 12.12 p.2 - non-stop before the stop line - 800 rubles.

I would like to note that drivers are not always to blame for not allowing a pedestrian to pass. There are also enough situations when pedestrians abruptly jump out onto the roadway. Although, according to the rules, a pedestrian must assess the traffic situation and only after that start moving across the road.

If you can prove with the help of a DVR that it was the pedestrian who suddenly appeared on the road, although you slowed down according to the rules and assessed the traffic situation, then the pedestrian will face a fine of 500 rubles. The same applies to those cases when pedestrians cross the road at a red traffic light.

As practice shows, it is much more difficult to talk to pedestrians, especially if they are older people. In order not to create emergency situations, you need to understand a little about the psychology of people and it is better to once again show them with a gesture - “Come in, they say,” than to pay fines later. Moreover, there are a lot of video recording cameras on the roads of cities now.

There is also no clarity about not allowing a pedestrian to pass if you turn right at an intersection on a red light. This maneuver is allowed if you do not interfere with other road users. However, if a pedestrian starts moving from the opposite side, you may be stopped. In this case, you should appeal to the fact that you assessed the traffic situation and did not interfere with anyone.
