Everyone knows that the rights are a mandatory document, without which it is impossible to drive a vehicle. It should be noted that the category of certificates must exactly correspond to the category of the operated transport. These documents are issued for a certain period, after which motorists must replace them with new rights.

Reasons for replacing a driver's license

Motor vehicle owners may need to change their rights not only after the expiration of their validity period (today it reaches 10 years), but also for other reasons. An international driver's document is issued for no more than 36 months. It should be noted, however, that such rights must expire before the end of the validity period of a regular driver's license.

Replacement of a driver's license due to the expiration of the term

The reasons for replacing the document include the following factors:

  • loss or deliberate theft of a document (the fact of theft must be confirmed by an appropriate document issued by law enforcement agencies);
  • any damage (rupture, exposure to moisture, wear) that interferes with reading the data specified in the certificate;
  • change of surname or first name (when submitting documents for the replacement of rights, motorists need to attach a copy of the marriage certificate or other document confirming the fact of changing personal data);
  • change in the driver's appearance (plastic surgery, health problems and other circumstances that have radically changed the driver's appearance);
  • identification of forgery on the part of the driver, who received a certificate on the basis of forged documents, etc.

Some vehicle owners are willing to replace their driver's licenses early. The procedure for carrying out these events is not regulated by any regulatory legal acts. Motorists who decide to replace them a few months before the expiration of their rights should be guided by the explanations given by the State Traffic Inspectorate management (this information is freely available on the official website). They have the right not earlier than 6 months before the expiration of the validity period of the rights to apply for their replacement to the traffic police.

Where is the replacement of the ID made?

The procedure for replacing certificates, due to the fact that their validity period has come to an end, is regulated by Clause 3 of the Rules for the issuance of rights. This normative legal act states that the issuance of certificates is carried out only in the units of the State Traffic Inspectorate (here not only national, but also international rights are drawn up).

Russian citizens should apply to the traffic police department either at the place of their registration, or at the place of temporary residence.

Today, the current legislation allows motorists to submit documents to replace a driver's license at the place of circulation, without a territorial reference. Thanks to the common database, no difficulties arise when carrying out the registration of new documents.

What documents are required to replace rights

To replace the rights whose validity period has come to an end, in 2016 motorists need to collect a certain package of documentation (when contacting the traffic police, it is recommended that a motorist have with him both originals and photocopies of all certificates and official documents):

  • Old driver's license.
  • Any official document through which traffic police officers can identify the identity of a motorist. It can be either a civil passport or a military ID or a passport.
  • Certificate issued by a licensed private or public medical institution. This document must certify that the driver does not have any health problems and can drive the vehicle. The cost of such a certificate is on average 1 - 300 rubles. (the cost of these services depends on the region and type of medical institution). Starting from 2, this document must be presented only by those drivers who carry out a replacement license either due to health problems or due to the expiration of their validity. In other cases, the replacement of rights is carried out without this certificate.
  • An application on paper, written in free form, or on a standard form (you can ask the inspector of the State Traffic Inspectorate for it and fill it out on the spot).
  • Receipt confirming the fact of payment of state. fees for the services provided for the production of new rights.

Motorists can find out the current tariffs either by telephone or on the official website of the traffic police. Motorists can pay the state duty both in any bank and in special terminals. The form of payment for payment of the duty can be obtained both from the State Traffic Inspectorate and downloaded from the official website of the traffic police.

Is it required to pass an exam when changing rights

To replace the driver's license (which has expired due to the expiration of its validity) with a new document, motorists do not need to take any exams. In accordance with the current legislation, only students of driving schools at the end of their studies are subject to mandatory examinations. Therefore, drivers who have certificates that expired several years ago do not need to re-study the theory.

Is it possible to make a replacement if there are unpaid fines

Due to the fact that driving a vehicle with an expired driver's license is a violation of current legislation, traffic police officers have no legal right to refuse a motorist to replace a license. Even if there are outstanding penalties, they are required to issue a new document.

Some time ago, traffic police officers forced all drivers to pay all previously issued fines. In 2016, the situation has changed and vehicle owners do not have to face this problem.

Lawyers still recommend that motorists pay off debts to the budget before visiting the State Traffic Inspectorate. Despite the fact that the driver will be issued a new license, the inspector will draw up a protocol on the penalty for delay (such a financial penalty is imposed in double amount).

Fines for an expired driver's license

Federal legislation in force on the territory of the Russian Federation regulates the procedure for bringing to responsibility the owners of vehicles who were driving them with expired certificates. At the same time, it should be noted that not a single regulatory legal act says that a driver who has a license with a long-expired validity period, and who does not operate his car during this time, may be fined or brought to administrative responsibility.

A financial penalty can be imposed only if the driver is detained by the State Traffic Inspectorate for driving a vehicle with expired rights. The procedure for bringing to responsibility is regulated by Art. 12.7 KO AP. The maximum amount of the penalty can be up to 15 rubles. (the amount of the fine is directly influenced by the conditions under which the motorist was detained, as well as the presence of similar violations in the past). The minimum fine that can be imposed on an offender is 000 rubles.

Federal law does not prohibit drivers from replacing expired rights, therefore, no financial penalties will be applied to such a category of violators. In order not to have to experience unpleasant moments when communicating with traffic police inspectors, drivers need to carefully monitor the duration of their rights.
